Billing a. Leopardo will submit a pay application to the Owner on a monthly basis. The billing period will be the first of the month through the last of the month. b. Subcontractor will provide a pencil draw to Leopardo on a monthly basis. Format must be AIA G702/G703. c. All pencil draws are to be e-mailed to Michael Mastin (mmastin@leopardo.com) no later than the 20 th of each month (work to be projected through the end of the month). d. Subcontractor will provide schedule of values broken down by area and activity. Leopardo will review the schedule of values and may adjust as necessary. e. Subcontractor acknowledges that this project will require: i. Union labor and prevailing wages (whichever is more stringent) ii. Certified payroll and shall provide all required documents prior to receipt of payment f. This project is not tax exempt. All applicable taxes are to be included. Change Management a. Overhead and Profit on all Change Orders is limited to 15%* (SUBJECT TO FINAL CONTRACT AGREEMENT BETWEEN OWNER AND CONTRACTOR) Safety a) OSHA required safety compliance is to be complied with at a minimum. In addition, all work must comply with Leopardo’s Safety Program. b) All employees of subcontractors will be required to attend a safety orientation prior to starting any work on the job site. c) Weekly toolbox safety talks will be required of all subcontractors and documentation must be submitted to Leopardo on a weekly basis. d) All subcontractors will be required to submit a site specific safety program to Leopardo for review and approval prior to starting any work on site. e) Subcontractor shall provide fall protection 100% of the time for all employees working at elevated work locations that are six feet or more above grade level. f) Subcontractor includes covers for all openings created by this subcontractor equal to or greater than four square feet pursuant to OSHA guidelines. g) Subcontractor shall bear costs of any fines resulting from non-compliance with OSHA standards. h) LCI retains the right to remove any employee from the jobsite for non-safety/non-compliance with OSHA and LCI safety measures. i) Include trench boxes (if required) to safely excavate /install own work. j) Subcontractor includes plating over site utility trenches to provide protection for crane/truck traffic as required and shall take the necessary precautions to protect all lay down and staging areas from damage. k) Subcontractors are responsible for cutting metal decking for their work operations, even if framed openings are shown on the contract documents. i. Metal decking is being placed solid through all openings by the Structural Steel Subcontractor to satisfy OSHA requirements. ii. Once openings are cut open by any subcontractor, they must be secured according to OSHA requirements.

Provide all submittals and shop drawings as required by the contract documents. b) Leopardo intends to coordinate MEP systems and building structure using a BIM model. Subcontractors will be fully responsible for developing 3D object models of their systems and will
