SECTION 01400 QUALITY REQUIREMENTS
G. The testing firm will report directly to the Leopardo Companies Inc.. Copies of test and inspection reports will be furnished to the appropriate Subcontractors. The laboratory and its representatives will be instructed to promptly call to the attention of the Subcontractor, any instance of non-compliance with the requirements of the Contract Documents. Failure to so notify the Subcontractor shall not relieve the Subcontractor of any of its responsibilities for compliance or making good workmanship or materials which are not in compliance with the requirements of the Contract Documents.

A. Attention is directed to Division 0, Bidding and Contract Requirements, and to Division 1, General Requirements, which are hereby made a part of this Section.
H. Each Subcontractor shall cooperate with the testing firm and provide labor to assist with sample preparations where applicable.

NOTICE OF NON-CONFORMANCE

DOCUMENT CONTROL PROCEDURE
A. Leopardo Companies Inc. [Insert - and the Architect] may conduct observations/evaluations of the Subcontractor’s Work. Leopardo Companies Inc. and/or Architect’s reviews do not relieve the Subcontractor from compliance with the Contract Documents or necessary corrections for deficiencies thereof. Subcontractors whose Work does not meet the standards set by the Contract Documents will be notified by representatives of the Leopardo Companies Inc. using a Notice of Non-Conformance Form. The Subcontractor, upon receipt of the Notice of Non-Conformance, shall complete and return the form and provide the corrective actions necessary in a timely manner as outlined on the Notice of Non- Conformance. B. Control of nonconforming product: The Subcontractor shall establish and maintain documented procedures to ensure that product that does not conform to specified requirements is prevented from unintended use or installation. This control shall provide for identification documentation, evaluation, segregation (when practical), disposition of nonconforming product, and for notification to the functions concerned.
Each Subcontractor is to provide Leopardo Companies Inc. its document control procedure to include drawing submittals and surveillance. In the absence of such a procedure, the Subcontractor will use the following procedure for document control. “A log is maintained identifying the drawing revision status, issue date and distribution (internal and external). The transmittal issuing the changed documents will indicate what changes are made and indicate that the documents are approved for use. Subcontractor meetings include a review of approved drawings. The review is documented in the meeting minutes. Superintendent surveillance activities include monitoring Subcontractor drawing use.”

QUALITY CONTROL
A. Each Subcontractor is responsible to provide the Owner with a completed quality product for its Work. Each Subcontractor shall be responsible for any costs associated with re-testing and re-performing the Work as a result of the Subcontractor's poor performance or workmanship or other failure to comply with the Contract Documents. B. All Work shall be done by persons qualified in their respective trades, and the workmanship shall be first-class in every respect. Each Subcontractor is responsible for ensuring employees are appropriately trained. All materials and equipment furnished shall be the best of their respective kinds for the intended use and unless otherwise specified, same shall be new and of the latest design. C. The Subcontractor shall provide Leopardo Companies Inc., Owner and Architect access to the Work in preparation and progress wherever the Work is located at all reasonable times. [IF THERE ARE SPECIFIC VERIFICATION AND METHOD OF RELEASE REQUIREMENTS IN THE PRIME AGREEMENT, THESE SHOULD BE SPELLED OUT HERE]. D. Leopardo Companies Inc. and the Architect will have the authority to reject Work that does not conform to the Contract Documents or may require special inspection or testing, whether or not such Work is to be then fabricated, installed or completed. The Architect shall make all decisions with respect to questions concerning the quality or fitness of materials, equipment and workmanship. E. Failure by a Subcontractor to conduct its operations, means and methods and coordinate proper sequencing of the Work may cause the Leopardo Companies Inc. to withhold payment or any other means deemed necessary to correct non-conforming Work. F. [Coordinate the following with Section 01450] - The Leopardo Companies Inc. [may/will] employ without cost to the Subcontractors, a testing firm to perform such engineering laboratory services and on-site inspection as deemed necessary by the Owner, Leopardo Companies Inc. and/or the Architect to determine compliance with the requirements of the Contract Documents. This Work will not be a service to the Subcontractors for the performing of tests and checking of materials required of the Subcontractors.
C. Review and disposition of nonconforming Work: Nonconforming product shall be reviewed in accordance with documented procedures. It may be
a. reworked to meet the specified requirements, b. accepted with or without repair by concession, c. regraded products for alternative applications, or d. reject or scrap and dispose of nonconforming work and replace

SUBCONTRACTOR PERFORMANCE EVALUATION
A. Leopardo Companies Inc. will be evaluating Subcontractor's performance and will provide feedback during the life of the Project, on Subcontractor's performance, for the purpose of improving Leopardo Companies Inc.'s Subcontractor selection process for future project endeavors. B. Subcontractors will be requested to evaluate and provide feedback to Leopardo Companies Inc. on ways for improve on processes affecting the Subcontractors. None of these evaluations or feedback shall form part of the Agreement or Contract Documents.

SECTION 01450 TESTING AND INSPECTION SERVICES [REVIEW WITH A/E AND OWNER]

SUBCONTRACTOR’S RESPONSIBILITIES
PART 1 - GENERAL
A. [ COORDINATE WITH A/E’S SPECIFICATIONS AND WORK SCOPE DESCRIPTIONS] Each Subcontractor shall be responsible to provide and pay for all other testing associated with its scope of Work. Tests shall be made by a qualified independent testing agency approved by the Owner and Architect. Coordinate selection of the testing agency through the Leopardo Companies Inc.. The Subcontractor shall arrange and pay for the following services:

1. Inspections and tests specified as the Subcontractor’s responsibility in the various sections of the Specifications.
B. Except as indicated in this Section, refer to the various technical specification sections for specific testing requirements.
2. Inspections and tests required by the General Conditions including those tests required by codes, ordinances, or the approval authority of regulatory agencies.
1.02 SCOPE OF INDEPENDENT TESTING LABORATORY SERVICES
A. The Leopardo Companies Inc. and/or Owner will employ and pay for the services of an Independent Testing and Inspection Laboratory to perform the following testing.
3. Inspection and tests performed for the Subcontractor’s convenience.
B. Subcontractor shall cooperate with the laboratory to facilitate the execution of its required services. Employment of the laboratory shall in no way relieve Subcontractor's obligations to perform the Work.
