C. Subcontractor, upon signing the Agreement, shall obtain and forward to Leopardo Companies Inc. any and all Standard Product Warranties for products, materials and systems covered under its Agreement. The Manufacturer’s warranties do NOT relieve the Subcontractor from its warranty obligations under the Contract Documents. D. Special Warranties shall become effective on a date established by the Project Team. This date generally shall be the date of Final Completion of the Project or Substantial Completion of the Project or portions thereof as agreed upon by the Project Team. In the case of acceptance of a portion of the Work or Project, separate warranties shall be issued for those specific portions of the Project that were accepted, and shall be dated the date the specific portion was accepted. As additional Work is accepted, separate warranties for those specific portions of the Work shall be issued and properly dated. Issuance of warranties for a portion of the Work shall in no way become the basis for Application for Final Payment. E. If for any reason, the Bidder cannot warrant any part of the Work using products, materials, or construction methods that have been specified or shown, it shall notify Leopardo Companies Inc. in writing at least ten (10) days before the bid submission date, giving reasons together with the names of products and data on substitutions it can guarantee. Should the Bidder fail to so notify Leopardo Companies Inc. within this time period, it will be bound to all warranties and guarantees as set forth in the Contract Documents. F. Related Damages and Losses: In correcting Work that has been rejected as defective or otherwise failing to conform to the Contract Documents, whether before or after Substantial Completion, Subcontractor shall bear all related costs, including, but not necessarily limited to, the cost to correct the Work, the cost to correct all other Work that has been damaged by the defective or non-conforming Work, or that is damaged in the process of correcting the defective or nonconforming Work, and the cost of all additional testing and inspections and compensation for the Architect and/or Leopardo Companies Inc.’s services and expenses made necessary thereby. G. Reinstatement of Warranty: When Work covered by a warranty with a specific time period has failed and has been corrected by Subcontractor, the warranty shall be reinstated for a time period equal to the original warranty. H. Express warranties are in addition to implied warranties and shall not limit the duties, obligations, rights, and remedies otherwise available to the Owner or Leopardo Companies Inc. under the law. Express warranty periods shall not be interpreted as limitations on the time in which Owner or Leopardo Companies Inc. may enforce Subcontractor’s duties and obligation or their rights and remedies under the Agreement and applicable law. 1. Rejection of Warranties: The Owner and Leopardo Companies Inc. reserve the right to reject warranties and to limit selection to products with warranties not in conflict with requirements of the Contract Documents. I. Where the Contract Documents require a Special Warranty, or similar commitment on the Work or part of the Work, the Owner and Leopardo Companies Inc. reserve the right to refuse to accept the Work, until the Subcontractor presents evidence that the entities required to countersign such commitments are willing to do so.
B. When the Contract Documents require Subcontractor, or Subcontractor and a Subordinate Party to execute a Special Warranty, prepare a written document that contains appropriate terms and identification, ready for execution by the required parties. Submit a draft to the Leopardo Companies Inc. for approval prior to final execution.
C. Prepare a written document utilizing an appropriate form, ready for execution by Subcontractor and its Subordinate Party(ies). Submit a draft to Leopardo Companies Inc. for approval prior to final execution.
1. Refer to all other Divisions for specific content requirements and particular requirements for submitting Special Warranties.

SUBMITTALS
A. Submit [INSERT NUMBER OF ORIGINALS/COPIES] written warranties to the Leopardo Companies Inc. within fourteen (14) days of Substantial Completion organizing the warranty documents into an orderly sequence based on the table of contents of the Project Manual. If the project Team's Certificate of Substantial Completion designates a commencement date for warranties other than the date of Substantial Completion for the Work, or a designated portion of the Work, submit written warranties upon request of Leopardo Companies Inc..

1. Equipment/System Acceptance - This form will be completed for each piece of equipment or system for each contract that requires operational testing and/or training before acceptance. This will document the date of testing, the equipment tested, names of personnel which witnessed the testing and acceptance. 2. Owner Training Register - This form will be completed for each contract that requires training to be provided to the Owner’s personnel. This will document the date of training, type of training, names of the personnel trained and acceptance of the training.

PART 1 - GENERAL
1.01
RELATED DOCUMENTS
A. Attention is directed to Bidding and Contract Requirements, and to Division 1, General Requirements, which are hereby made a part of this Section.
B. The amount of time required for instruction on each item of equipment and system is that specified in individual sections or as mutually agreed upon between Subcontractor and Leopardo Companies Inc..
1.02
SCOPE
A. Procedures for demonstration of equipment operation and instruction of Owner's personnel. This will be coordinated through Leopardo Companies Inc..
C. Demonstrate start-up, operation, control, adjustment, troubleshooting, servicing, maintenance, and shutdown of each item of equipment at agreed-upon times, at designated location.

QUALITY ASSURANCE
D. Use operation and maintenance manuals as basis of instruction and review the contents of the manuals with personnel in full detail to explain all aspects of operations and maintenance.
A. When specified in individual Sections, require manufacturer to provide authorized representative to demonstrate operation of equipment and systems, instruct Owner's personnel, and provide written report that demonstrations and instructions have been completed.
E. Prepare and insert additional data in operations and maintenance manuals when need for additional data becomes apparent during instructions.
B. Leopardo Companies Inc. will provide list of personnel to receive instructions, and will coordinate their attendance at agreed-upon times.
F. [OPTIONAL INSERT, IF REQUIRED Subcontractor is responsible for video taping the training sessions. The videotape should be of professional quality and the Owner should be provided with three (3) copies of the videotape.]

SUBMITTALS
A. Submit preliminary schedule to Leopardo Companies Inc. for Architect's and Owner's approval, listing times and dates for demonstration of each item of equipment and each system, at least two (2) weeks prior to proposed dates. B. Submit [INSERT NUMBER OF ORIGINALS/COPIES] reports within one week after completion of demonstrations, that demonstrations and instructions have been satisfactorily completed. Give time and date of each demonstration, and hours devoted to demonstration, with a list of persons present.

PART 2 - EXECUTION
2.01
PREPARATION
A. Provide substantiating information that verifies equipment has been inspected and put into operation; testing, adjusting, and balancing has been performed; and equipment and systems are fully operational.
B. Submit copies of completed operation and maintenance manuals (see Section 01730) at least two (2) weeks before execution and have at hand for use in demonstrations and instructions.
C. Leopardo Companies Inc. will develop a schedule for the system demonstration, training, start-up and turn over of all systems and equipment. [INSERT IF APPROPRIATE “Leopardo will provide video personnel to document Owner training provided by the subcontractors and furnish two (2) DVD copies to the Owner]
2.02
DEMONSTRATION AND INSTRUCTIONS
A. Demonstrate operation and maintenance of equipment and systems to the Owner’s, Leopardo Companies Inc.’s and Architect's personnel two (2) weeks prior to date of final inspection. For equipment requiring seasonal operation, perform instructions for other seasons within six months. Subcontractor shall document the testing, equipment start-up and training sessions as required using an appropriate form.
