CDP BRANGUS TERMS AND CONDITIONS
BIDDING & ANNOUNCEMENTS Each animal will sell to the highest bidder. The auctioneer shall settle any dispute as to bids, and the auctioneer’s decision shall be final. Any announcements or changes made from the auction block or printed in a sale-day supplement shall take precedence over catalog information. TERMS OF SALE & PAYMENT All sales are cash unless prior credit arrangements have been made with the seller or CDP BRANGUS. Payment is due within 30 days of the sale date. Accounts not settled according to these terms will be subject to interest charges assessed by CDP BRANGUS. RISK, CARE & LOAD OUT Each animal becomes the risk of the purchaser immediately upon sale. The seller will provide care until the animal is loaded for ship- ment or for 48 hours following the sale, whichever occurs first. After 48 hours, a maintenance fee of $3.50 per head per day, plus any veterinary charges incurred, will be assessed until pickup. Cattle will be available for load out immediately after the sale once proper settlement has been made. Buyers wishing to load out at a later date should notify sale staff at checkout so arrangements can be made. DELIVERY & TRANSPORTATION CDP BRANGUS will make every effort to assist buyers in coordinat- ing reliable and economical trucking. Unless otherwise stated in these terms, trucking expense is the responsibility of the purchaser. Buyers may also make their own transportation arrangements. Animals become the purchaser’s responsibility at the time of sale. Neither CDP BRANGUS nor the breeders involved in the sale assume responsibility for injury occurring during transport. Insurance is available for buyers who desire coverage. REGISTRATION & HEALTH A transferred certificate of registration will be furnished for each registered animal within a reasonable time after proper settlement. Interstate health papers suitable for interstate shipment will be pro- vided in accordance with all applicable federal and state regulations. SIGHT-UNSEEN PURCHASES Buyers may purchase cattle through CDP BRANGUS personnel with- out viewing the cattle in person. For sight-unseen purchases, the buyer has the right of inspection at delivery. If the animal is deemed unsatisfactory at delivery, it may be reloaded on the delivery truck at no obligation to the buyer, and transportation expenses in this instance shall be the responsibility of CDP BRANGUS. If the purchaser is unable to inspect the animal upon delivery, the buyer shall have one (1) week from delivery to determine satisfac- tion. If returned within this period, the buyer may, at the buyer’s expense, return the animal to CDP BRANGUS for a refund of the pur-
chase price. DVAuction purchases are excluded from this guarantee.
BREEDING GUARANTEE General Guarantee All animals are guaranteed breeders except: • Calves under 12 months of age at the time of sale. • Animals shown or exhibited by the purchaser after the sale unless otherwise agreed upon. • Animals injured or deceased after the sale. • Animals subjected to gross negligence or willful misconduct by the purchaser. Bulls All bulls selling in this sale have passed a Breeding Soundness Eval- uation (BSE) by Dr. Mike Pallone of Pallone Veterinary Hospital and are considered satisfactory potential breeders. Bulls are guaranteed as breeders through the first breeding season, provided they are properly maintained and remain healthy. Proper management is required. As a guideline, 12- to 15-month-old bulls should be used at a ratio of one bull to no more than 15 cows, and 16- to 20-month-old bulls at a ratio of one bull to no more than 20 cows. This guarantee does not apply if these requirements are not followed or if young bulls are placed in service with, or housed with, mature bulls before or during their first breeding season. For bulls purchased in the fall and first used in the spring, or pur- chased in the spring and first used in the fall, the 90-day breeding guarantee begins at first turnout, provided the bull has been main- tained in good condition, has not been run with older mature herd bulls, was at least 12 months old at the time of sale, and was not exposed prior to 14 months of age. The seller does not guarantee death loss or injury. No guarantee is made regarding a bull’s ability to freeze semen unless otherwise agreed upon by the seller. Non-Breeder Claims - Bulls If a question arises regarding a bull’s breeding soundness, contact CDP BRANGUS, Craig Green at 870-834-1976, before returning or shipping the bull. Shipping an animal believed to be unsatisfactory before contacting CDP BRANGUS will void the guarantee. If a bull is claimed to be a non-breeder, the seller reserves the right to retain the bull for a six (6) month trial period to demonstrate breeding ability. A bull that settles cows by natural service and passes a fertility examination performed by a mutually agreed-upon licensed veterinarian during the trial period shall be considered a breeder. If proven to be a breeder, the claim is fully resolved and the buyer shall resume possession of the bull. Transportation expenses associated with returning the bull to the buyer shall be the responsi- bility of the buyer.
