CWUP 2-40-070 Consensual Relations

(1) Purpose. The purpose of this Consensual Relations policy is to prevent conflicts of interest arising from consensual romantic or sexual relations between employees and students or between employees and persons with respect to whom the employees are in a position of supervisory or professional responsibility. (A) Consensual Relations with Students. CWU faculty and staff employees are strictly prohibited from engaging in consensual romantic or sexual relations of any kind with any person enrolled as a CWU student. The term “employee” for purposes of this subsection shall not include student employees. (B) Consensual Relations with Subordinates. CWU faculty and staff employees (including student employees) are strictly prohibited from serving in a position of supervisory or professional responsibility with respect to any person, whether a student or non-student, with whom they have had, are currently having, or are pursuing a consensual relationship of a romantic or sexual nature. (A) Student. The term “student” for purposes of this policy includes all persons taking courses at or through CWU, whether on a full-time or part-time basis, and whether such courses are credit courses, noncredit courses, online courses, or otherwise. (B) Supervisory or Professional Responsibility. An employee is in a position of “supervisory or professional responsibility” with respect to another person when the employee is the other person’s supervisor or otherwise has the capacity to exercise supervisory or professional authority or influence with respect to the educational or employment interests of the other person. (3) Spousal Exemption. This policy shall not apply to employees who are in a spousal relationship with a student, defined as a legally recognized marriage under RCW 26.04 or domestic partnership under RCW 26.60. Nor shall this policy apply to employees who can demonstrate to their appointing authority that they are in a relationship with a student that is substantially in the nature of a marriage or domestic partnership. Conflicts of interest involving such spousal relationships shall instead by governed by the CWU Nepotism Policy , CWUP 2-40-260. (4) Policy Violations. Employees found to have violated this zero-tolerance policy shall be subject to disciplinary action at an advanced step of progressive discipline, including termination for cause. (2) Definitions.
