Definition of Disability

The standard definition of disability means that , due to a non-occupational illness or injury, an employee is unable to perform all material and substantial duties of his or her regular occupation, which results in at least a 20 percent loss in pre-disability earnings. The employee must also be receiving regular care from a physician for the illness or injury. Pregnancy or complications of pregnancy are covered the same as an illness The Weekly rate of earnings immediately prior to the date of Disability. Commissions/bonuses will be averaged over a 12 month period.

Disability means that, during the period of time stated in the Proposal as "Own Occupation", an employee is unable to perform all material and substantial duties of his or her regular occupation, which results in at least a 20 percent loss in pre-disability earnings. After that period of time, Disability means an employee is unable to perform the material and substantial duties of any gainful occupation, which results in at least a 40 percent loss in pre-disability earnings. The Monthly rate of earnings immediately prior to the date of Disability. Commissions/bonuses will be averaged over a 12 month period. A pre-existing condition is an illness or injury for which you received treatment or where symptoms were present within 3 months prior to your effective date of coverage. A disability that begins in the first 12 months after your effective date will not be covered if it results from a pre-existing condition
