We act on behalf of the Claimant/Applicant in the above-named claim.
The Applicant has today filed an application for permission to rely on further witness evidence under CPR Part 8.6(1)(b) (the "Application"). under CPR Part 8.6(1)(b) (the “Application” ).
The Applicant considers that the Application is suitable to be determined at the Disposal Hearing, which is to be listed for a 1 day hearing in a 2-day window covering 8 July 2024 and 10 July 2024.
Alternatively, if the Court is minded to determine the Application separately, the Applicant considers that it is suitable to be determined by a Master on the papers.
Please note due to its size, the exhibit to the Second Witness Statement of Julian Diaz-Rainey (JDR2) has not been filed with the Court. Exhibit JDR2 has been served on the Defendants and it will be provided to the Court ahead of the Disposal Hearing in a separate bundle.
