DOMESTIC VIOLENCE DEFENSE

Florida law states that domestic violence can be actionable as both a criminal offense and as a civil tort. Domestic violence has both criminal and civil ramifications that can be rather severe. Once law enforcement is called to intervene in a domestic incident, the state is most likely going to take criminal action against the perpetrator, even if the person who claims they were victimized doesn’t want to press charges. Domestic violence charges in Florida are especially harsh — sometimes more harsh than necessary — because prosecutors are dedicated to deterring incidents of domestic violence. The advocacy of an attorney is vital to anyone facing either criminal or civil domestic violence charges. An Uphill Battle From the Start In most other criminal cases, a person is able to post bond and leave jail shortly after the arrest. However, individuals facing domestic violence charges have special conditions placed upon them once released from incarceration. Once an individual who is arrested for domestic violence is released, they are prohibited from engaging in certain conduct pending the trial or disposition of the charge. These persons typically are restricted in their ability to travel outside the county and are also prohibited from contacting the victim, even if the victim lives in the accused’s residence.

In Florida, the state attorney can proceed with charges even if the victim refuses to press charges or refuses to cooperate. In almost every case, the state has every intention of prosecuting the defendant. Those accused face an uphill battle from the start, and the exposure and stigma can unfortunately last a lifetime. A Stain on Your Record Should an individual plead guilty or no contest to a domestic violence charge, the infraction can never be sealed or expunged. This means it will stay on record indefinitely, and any time this individual applies for a job, loan, scholarship, or anything else that requires a background check, the charge will “pop up,” and so will its undesirable consequences. Those facing domestic violence charges may be ordered to complete months of counseling and will be prohibited from contacting the alleged victim.Additionally, the court could require alcohol and substance-abuse evaluation and screening as well as addiction and psychological treatment, a batterer’s intervention or anger-control program, and restitution. Someone charged with a criminal act of domestic violence may also face jail or prison time and a lifelong criminal record.
