LAUGH IT OFF

We’ve all seen an unlucky person on the side of the road with the police doing what looks like a standardized field sobriety test (SFST) and have said a little prayer for them as we drive by. While many are familiar with the process and purpose of a standardized field sobriety test, it’s very important to know the National Highway Traffic Safety Administration (NHTSA) has standardized three components of it in Georgia. The first test is known as the horizontal gaze nystagmus, or the “eye test.” During this test, the police officer will observe your eyes, looking for jerking movements of your eyes while you focus on certain stimuli. The problem is that some people have a natural nystagmus, whether or not they are impaired. The second test is the walk and turn test, consisting of nine heel-to-toe steps on a straight line, a 180-degree turn and nine more steps back to the starting point. If directions aren’t followed exactly, the officer may have reason to believe you are intoxicated. The final test is the one leg stand in which you must stand on one foot for 30 seconds with your arms by your side, which can be difficult if you have poor balance. These tests are voluntary! However, the police officer on scene likely will not share this information with you because they want you to take them. It is up to you to refuse them, and there is no penalty for doing so like there is if you refuse to take the breath test. By having you take the tests, the officer can build evidence against you to convict you of a DUI. Many times, clients have thought they performed well on the tests, but the police report says they failed in more than one area. The standardized field sobriety tests are designed for you to fail them, which should be even more of a reason for you to always refuse to take one!
