Recovery of Damages for Medical Negligence Resulting in Death – VETOED (AARP Supported) House Bill 6017, by Representatives Trabulsy & López (companion Senate Bill 734, by Senator Yarborough). This legislation would have removed section 768.32 (8) and amended sections 400.023, 400.0235, and 429.295, Florida Statutes. The legislation would have allowed Florida families to hold medical providers civilly responsible for the wrongful death of an adult family member, regardless of whether the deceased had minor children, was widowed or unmarried. It would have repealed a section of Florida law that barred parents and adult children from recovering noneconomic damages in cases of wrongful death caused by medical negligence. In circumstances involving the wrongful deaths of older and/or vulnerable adults noneconomic damages are often the only significant form of relief available and, therefore, the only way of holding negligent healthcare professionals civilly accountable.
