Fraudulent Use of Gift Cards - PASSED (AARP Supported) Senate Bill 1198, by Senator DiCeglie (companion House Bill 1007, by Representative Greco). Approved by Governor; Chapter No. 2025-151, effective October 1, 2025. The legislation defines several forms of fraud involving gift cards and provides Florida law enforcement with greater clarity regarding the valuation of and applicable penalties for such offenses. It specifies that unlawfully obtaining the redemption information from a gift card (commonly referred to as “gift card draining”), as well as altering or tampering with the gift card itself constitutes at least a first-degree misdemeanor offense, regardless of whether the card has been activated. The legislation also provides enhanced penalties for individuals with prior convictions.
