Virtual Currency Kiosk Businesses - FAILED (AARP Supported) House Bill 319, by Representative Fabricio (companion Senate Bill 292, by Senator Burton, never had a hearing). The legislation would have amended sections 560.103 and 560.105, and created sections 560.501-506, Florida Statutes. Currently, virtual currency kiosks (i.e., cryptocurrency ATMs) are not regulated as money transmitters and operate across Florida without any state oversight. The legislation would have created a regulatory framework and minimum standards for virtual currency kiosk businesses operating in Florida, requiring them to register with and report to Florida’s Office of Financial Regulation. It would have further required virtual kiosk businesses to provide certain disclosures and obtain customer attestations to help mitigate the risk of kiosk-facilitated fraud.
