The legislation would have refined the My Safe Florida Home Program by ensuring hurricane mitigation grants are awarded only for improvements that lead to insurance premium reductions. It would have raised minimum surplus requirements for residential property insurers, with staggered deadlines for compliance. Additionally, it would have barred individuals involved in insolvent insurers from holding key positions as authorized insurers for five years. The bill also sought to prevent the Office of Insurance Regulation (OIR) from extending the review period for insurance rate filings that propose decreases unless the reduction was due to coverage changes. Insurance – FAILED House Bill 1047, by Representative Berfield. The legislation would have amended multiple sections in 624, 626, 627, Florida Statutes. The legislation would have clarified “sufficient evidence” standards for bad faith claims against liability insurers, reduced coursework requirements for general lines agent licensure and limited claims-handling manual requirements to active residential property insurers. It would have prohibited adversarial conduct by public adjusters, restricted appointment type disclosures in initial texts and allowed policy cancellation if the insured no longer had an insurable interest. Additionally, it would have corrected flood insurance disclosure language and required written proof-of-loss statements. Patient Referrals by Medicaid Managed Care Organizations and Managed Care Plans - FAILED House Bill 815, by Representative Basabe (companion Senate Bill 1478, by Senator Rodriguez). The legislation would have amended section 409.962, Florida Statutes. The legislation would have required the Agency for Health Care Administration (AHCA) to contract for an analysis of Medicaid managed care plan referrals to affiliated providers to examine financial ties, such as ownership, control and profit-sharing. AHCA would have been required to submit a report on its findings to state leadership.

My Safe Florida Home Trust Fund/Department of Financial Services - FAILED (AARP Supported) Senate Bill 1466, by Senator DiCeglie (companion House Bill 851, by Representative LaMarca, never had a hearing). Legislation would have created section 215.55861, Florida Statutes. The legislation would have created the My Safe Florida Home Trust Fund within the Department of Financial Services. Funds would have been used exclusively for the My Safe Florida Home Program. After the declaration of an emergency, 20% of insurance premium tax revenue would have been directed into the trust fund, but the total balance could not exceed $300 million. The trust would have terminated on July 1, 2029, pending review.
