1 The Claimant was dismissed. It is accepted that if dismissed, her dismissal was unfair. Her complaint of unfair dismissal is therefore well founded.

2 The matter will now be listed for a further hearing to determine the question of remedy.



1 The Claimant complains of unfair dismissal and breach of contract (failure to give notice).


2 It was agreed that, dealing with liability first, the issues to be decided by the Tribunal in respect of the complaint of unfair dismissal were as follows:-

2.1 Were acts or omissions of the Respondent a cause of the Claimant’s resignation?

2.2 If so, was the Respondent, by those acts or omissions, in repudiatory breach of the Claimant’s contract?
