CASE EXAMPLE I (2013) • A general manager at a Casino Resort, used a Tribal casino credit card to purchase personal items. • He was indicted in 2009 and again in 2010 on three counts of theft and six counts of mail fraud. A jury convicted the Defendant on all counts. • On appeal, the Defendant challenged the 2010 indictment, claiming that it did not allege that the Casino is on Indian lands. • The Court found that the Casino did not need to be on Indian lands since the law only requires the gaming establishment by operated pursuant to an approved ordinance or resolution. 36
