STRICTER STANDARDS, SAFER ROADS GEORGIA’S COMMERCIAL DUI LAW EXPLAINED

In the state of Georgia, commercial truck and bus operators rely on their commercial driver’s licenses (CDL) to sustain their careers. Just the thought of being charged with or convicted of a commercial DUI can send shivers down any driver’s spine, as it threatens their CDL and their financial security. GEORGIA’S COMMERCIAL DUI LAW According to section 40-6-391 of the Official Code of Georgia Annotated, any driver operating a vehicle on public roads with a blood alcohol concentration (BAC) of 0.08% or higher can be arrested and charged with DUI. However, the legal threshold for those piloting commercial vehicles is significantly lower. Georgia law and the Federal Motor Carrier Safety Administration (FMCSA) enforce that anyone operating a commercial vehicle with a BAC of 0.04% or more will be arrested for a commercial DUI. This stricter limit is enforced because of the increased liability commercial drivers have. Imagine the potential devastation that an impaired bus driver could cause with passengers on board. Similarly, an intoxicated truck driver could be transporting flammable cargo, and if they were to cause an accident, the destruction could be haunting.
