THE BEST IN TOW PROGRAM RULES The following rules apply for qualifying applicants in the National Interstate Insurance Company (“National Interstate”) TowCap Premier Alternative Risk Program and the International Towing & Recovery Hall of Fame & Museum’s (“Hall of Fame”) Best in Tow Program and safety contest (the “Program”). ELIGIBILITY: The Program is open to U.S.-based (excluding U.S. territories) towing and recovery specialist operators (“Applicants”) who have at least fifteen (15) power units. An Applicant need not be insured by National Interstate to participate in or be eligible for the awards under this Program. DURATION: The Program will consider Applicants’ safety and commercial auto liability loss results for the period of June 30, 2023 – June 30, 2024 (the “Loss Evaluation Period”). Complete submissions must be received by National Interstate Insurance Company (“National Interstate”) no later than August 31, 2024 (the “submission cut-off date”). DETERMINATION OF WINNERS: All Applicants must submit the following prior to the submission cut-off date: (i) insurance company-issued auto liability loss runs, inclusive of the Loss Evaluation Period assessed no earlier than July 1, 2024. Loss runs must include loss date, date loss reported to the insurance company, and total incurred loss amount; and (ii) documentation for all applicable best practice subcategories as described in Section 4 of the Program Guidelines. National Interstate shall calculate Applicants’ points based on each category and subcategory and corresponding points earned as listed in the Program Guidelines. AWARDS AND CONSUMER DISCLOSURE: As determined based on the cumulative points earned by Applicants, awards will be given to the three (3) highest scoring best-in-class towing and recovery specialist operators and awarded at the 2024 International Towing Museum Weekend. The highest scoring Applicant will receive $10,000; the second-highest scoring Applicant with receive $5,000; and the third-highest scoring Applicant will receive $2,500. In the event of a tie, the awards will be split among the winning Applicants. For example, if two (2) or more Applicants tie for second place, the amounts for second and third place will be added together and split among the Applicants tying for second place and no separate third place award will be made. TowCap Premier membership will contribute to the International Towing & Recovery Survivor Fund. By accepting an award, the Applicant agrees to release National Interstate and the Hall of Fame and their respective officers, directors, employees, and agents from any and all liability, loss, or damage of any kind arising out of or in connection with Applicant’s participation in the Program, or with respect to the awarding, receipt, possession, use, and/or misuse of the award, or the participation in prize-related activities. By accepting an award, the Applicant further agrees that National Interstate and the Hall of Fame & Museum are not responsible or liable for any warranty, representation, or guarantee, express or implied in fact or in law, relating to the award, or any portion thereof, including but not limited to its quality, merchantability, mechanical condition, or fitness for a particular purpose. Award recipients will be responsible for all federal, state, and local taxes, and any other expenses associated with acceptance of the award. The award is provided by National Interstate Insurance Company, having its headquarters at 3250 Interstate Drive, Richfield, OH 44286. LICENSE GRANT: Any Applicant who provides information (“Applicant Generated Content”) in response to this Program grants National Interstate a non-exclusive, worldwide, royalty-free, irrevocable, and perpetual license to use, edit, modify, aggregate, reproduce, distribute, display, and prepare derivative works of Applicant Generated Content in any form or format and unconditionally waives all moral rights with respect to such Applicant Generated Content. For the avoidance of doubt, the license granted allows National Interstate to use such Applicant Generated Content for commercial purposes such as, without limitation, advertising campaigns and Applicant shall not be entitled to any remuneration for such use. Award acceptance constitutes permission (except where prohibited) to use winner’s name and likeness for publicity purposes without additional compensation and winner agrees to sign a Publicity Release (except where prohibited) provided by National Interstate as a condition to accepting award. OFFSET: Any Applicant to receive an award agrees that any award amount may be offset against monies owed to National Interstate, its affiliates, or the Hall of Fame. INELIGIBLITY: As set forth in Section 3 of the Program Guidelines, any Applicant that incurs an auto liability or workers’ compensation claim of greater than $1 million during the Loss Evaluation Period will be automatically disqualified from the Program and ineligible to receive an award. An Applicant whose insurance has been mid-term cancelled or non-renewed by National Interstate is ineligible to participate in the Program. OTHER: National Interstate and the Hall of Fame & Museum reserve the right to interpret these rules and, if necessary, to amend the rules in their discretion and without notice to Applicants. All decisions are final. NOTE: The first-place winner of the most recent Best in Tow Program is ineligible to receive first place for the current Best in Tow Program; however, the prior first-place winner is eligible for the second or third place award. If there is a tie, the awards will be split amongst the winning participants. National Interstate reserves the right to modify the terms of the program at any time.
