General Information
Turn Around Times Products with a new custom logo will ship in 18 working days or less from day of art approval. Products with existing logo or no logo will ship in 10 working days or less. Shipping All orders are shipped via UPS unless otherwise requested by the customer at time of order. Customer agrees that the risk of loss and title for any product passes to customer upon our delivery to the shipping carrier. The Cawley Company is not responsible for any delays in shipping once the product leaves our facility. It is the customer's sole responsibility to review billing and shipping information provided to The Cawley Company prior to submitting your order. The Cawley Company will not be responsible for reshipping packages at our expense due to missing information or typographical errors. If a package is returned to The Cawley Company due to incorrect shipping information, we will contact customer and reship the package at your expense.
Drop Shipping When the total order is prepared and shipped to multiple destinations at one time, a $3.00 drop ship charge per destination applies.
Payment Terms Payment terms are Net 30. Foreign shipments require letter of credit or cash in advance. To open an account please complete the accounts payable section on your first order. We accept check, VISA, Mastercard and American Express. Sales Tax Sales Tax is charged on all shipments to states that The Cawley Company has economic nexus in. Tax-exempt accounts or resale accounts within the United States can be established by supplying a copy of your tax-exempt or resale certificate for each state customer has product shipped to. Rush Production Requests Rush orders describe deliveries shipped faster than normal production time with factory approval. The additional fee for rush orders, in addition to shipping charges are: First time orders shipped within 10 business days, $25 - order value up to $500, $50 - order value of $501-$1,000, $75 - order value in excess of $1,000. Existing items in stock: Next Day - $30 Express in 4 days - $20, Rush 5-9 days - $10. Production Time This is the time between approved artwork of the product and the time the product ships from our facility. The order does not begin until the written purchase order and all the other necessary information is received. Production lead times are shown for each product.
Correction or Cancellations Customers that cancel orders during production will be charged for cost of work completed at the time of cancellation.
Returns Stock and non-personalized items: Items can be returned if Dispute Notification occurred within the prescribed time-frame following order receipt. Upon Customer Service approval of the dispute (call 1-800-8CAWLEY), you will receive a Return Materials Authorization (RMA) number before shipping any product back. You are responsible for paying return shipping costs unless an error has been made by The Cawley Company (in which case special arrangements will be made to cover shipping costs). If the return is not the fault of The Cawley Company, a 15% restocking fee will be assessed against the refund to be issued to customer once product is received and found to be in resalable condition. Please use a traceable and/or insurable carrier for your return shipments, as The Cawley Company is not liable for lost or misdirected shipments sent to us. Returns should be sent with RMA to The Cawley Company1544 North 8th Street, Manitowoc, WI 54220. Custom or personalized items: Due to their unique nature, custom and personalized items are not refundable. Please review your proof(s) carefully prior to submitting an order. Your approval of a proof constitutes your acceptance of an order meeting the specifications as listed on the proof. If your order does not match the specifications listed on the proof or there is another type of defect however, we will correct the order at no cost to you. If, however, the error was not the fault of The Cawley Company, the order shall be considered complete and payment is expected in full. Order Dispute Upon receiving an order, you have 30 calendar days to dispute charges with The Cawley Company related to your order if you feel your order is damaged or incomplete. The Cawley Company is not responsible for damage to the products arising after delivery to the customers. After the 30 day period, the order is considered “closed” and full payment is expected. Your satisfaction is our top priority and we are willing and interested in working with you in an attempt to make you a satisfied customer. Please feel free to contact Customer Service at any time. Pre-Production Samples These are charged at the quantity of 1 plus any artwork charges, or die charges. If the sample is approved without any changes, these charges will be applied to the final production of the order.
Rights to Promotion We reserve the right to use all products in our advertising and displays unless otherwise specified in writing at the time of order.
Limited Warranty The Cawley Company products are warranted against all defects in materials for a period of one year from date of invoice. Except as expressly stated herein, The Cawley Company expressly disclaims all warranties, express or implied, of any kind with respect to products sold, including but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to The Cawley Company arising from any product sold shall be the price of the product ordered. In no event shall The Cawley Company, its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to product sold.
