A message from MADD California State Executive Director

We want to thank you for considering a partnership with MADD California. We are a high-profile non-profit organization empowered by generous donations, solid sponsorships, innovative fundrais- ing opportunities, and collaborative partnerships. All in an effort to deliver vital programs directly to the community, at no charge. In 2019, we have an abundance of collaborative opportunities available - designed to help you share your corporate message while positively impacting our communities. This year our line-up of events include: Walk Like MADD 5K’s, Power of Youth / Power of Parents Presentations, Teen Influencer Summits, Law Enforcement Recognition Awards, Safety Galas and more! Mothers Against Drunk Driving (MADD) always welcome the opportunity to develop new collabora- tive partnerships which will further our mission to end drunk and drugged driving, serve the victims / survivors of this violent crime and prevent underage drinking. OUR MISSION

Founded in 1980, Mothers Against Drunk Driving® (MADD) is the nation’s largest nonprofit dedicated to:

MADD CALIFORNIA 2019

MADD California is responsible for 100% of the population of the State. This feat would never be accomplished without the volunteers involved with the Volunteer Speakers Bureau, which we consider to be an integral part of the success of MADD throughout the Nation. Each of our volunteers has a personal understanding of the ramifications that impaired driving can cause. They donate hundreds of hours out of their busy schedules to share their stories in hopes of saving the lives of others. They stand beside us at press events, participate in “Every 15 Minutes” pro- grams, DUI checkpoints and help deliver school and probation department presentations. In 2018-2019, our staff and volunteers traveled all over California delivering MADD’s core programs and services, all of which are free of charge to the public. We are able to offer free services due to the support from generous donations, grants, foundations, and collaborative sponsorships. With this support, our Volunteer Speakers Bureau provided prevention education presentations to thousands of youth, adults and military members in our communities. In 2018-2019 alone:  In California, MADD provided over 2,000 supportive services to drunk and drugged driving victims to help them cope with the devastating impact of substance-impaired driving crashes. When tragedy strikes, victims need support. MADD prides itself on being one of the largest victim services organizations in the country. Part of those services include ensuring a victim’s rights are maintained. From making a victim impact statement to notification of offender status, victims have rights thanks to the Victim Rights Act of 2004.  MADD California Underage Drinking Prevention Program provided over 370 presentations to parents and youth in support of almost 200 schools, community organizations, and local law enforcement departments.  Volunteers and staff distributed close to 260,000 educational materials at over 180 checkpoints and almost 220 community events, reaching over 110,500 people.  We recognized more than 1,750 peace officers at our 2019 law enforcement recognition events in California for their life-saving work in DUI enforcement and traffic safety.  We sent our crash car exhibit to different locations across California to schools, press events, military bases, checkpoints and provided presentations to new law enforcement recruits.  We provided Victim Impact Panel presentations, in English and Spanish, to over 34,400 DUI offenders, through our Victim Impact Panels.

MADD asks you to join these meaningful virtual events and to take a stand with MADD to be #OneMADDCalifornia. In our 40th year, as THE grass roots organization that started the cultural revolution that made drunk driving unacceptable, we ask that you take a stand with #OneMADDCalifornia to further a future with NO MORE VICTIMS. Join Mothers Against Drunk Driving and help create a future of No More Victims®. You can play a key role in keeping our roads safe. Not only would your sponsorship help MADD fulfill its mission to end drunk driving, help fight drugged driving, support victims, and prevent underage drinking, it also provides unparalleled exposure for your company. Walk Like MADD is our signature fundraising event to help us raise both awareness and funds to end drunk driving and fight drugged driving. Many who participate have a common bond, they know someone who has been injured or killed in a drunk driving crash, or they feel strongly about creating a future of No More Victims®. In 2019, more than 90 cities across the nation hosted Walk Like MADD events. With every step taken and each dollar raised, we support MADD ’ s lifesaving mission to keep our families and communities safe.

DONATIONS AND SPONSORSHIPS AT WORK IN THE COMMUNITY

First there’s the crash, then the lifelong impact…. Last year, MADD provided more than 160,000 supportive services nationally to drunk and drugged driving victims.

OUR MISSION MADD supports victims and survivors of drunk and drugged driving at no charge. Victim advocacy services include:  Court accompaniment, criminal justice education.  Liaison with law enforcement, prosecutors, and probation department.  Assistance with court case tracking.  Resource referrals: financial aid, housing assistance, counseling, support groups, etc..  Extensive grief and injury literature.  Emotional support.  MADD Victim Advocates provide a service every four minutes through local affiliates and our national 24-Hour Victim Help Line 1-877-MADD-HELP.

DONATIONS AND SPONSORSHIPS AT WORK IN THE COMMUNITY

POWER OF YOUTH® Informs high school students of the science behind the legal drinking age of 21 and safe driving practices. This interactive program presented in classroom or assembly settings is effective in generating discussions about the conse- quences of poor choices and working to prevent underage drinking.

POWER OF PARENTS® educates parents about their influence with their teens and equips them with the conversational tools nec- essary to talk about alcohol.

MADD’s CAMPAIGN TO ELIMINATE DRUNK DRIVING® focuses on four important philosophies:  Support our heroes. Support law enforcement efforts to catch drunk drivers and discourage others from driving drunk.  Sober to start. Require ignition interlock devices, or in-car breathalyzers, for all drunk drivers, to prove they are sober before their car will start.  Secure the future. Support the development of technology to automatically determine whether drivers are above the legal limit of .08 BAC and stop drunk drivers from operating vehicles.  Public Support. It’s everybody’s responsibility to eliminate drunk driving. Re-engage the public in the fight against impaired driving.

MADD’s TIE ONE ON FOR SAFETY® campaign calls for motorists to display a red ribbon on their vehicles in support of law enforcement efforts and as a reminder to plan ahead and designate a non-drinking driver.

ONE-TIME DONATION AND/OR SPONSORSHIP AGREEMENT PAGE

This sponsorship agreement (“Agreement”), effective this _______ day of _____________________, 20____ (hereinafter the “Effective Date”), by and between Mothers Against Drunk Driving® (“MADD”), headquartered at 511 E. John Carpenter Freeway, Suite 700, Irving, Texas 75062, and _________________________________________ (“Sponsor”), located at ________________________________________________ (“Sponsor”). The purpose of this Agreement is to allow _________________________________________ to become a local sponsor of MADD Southern California programs (“the Program”).

By signing this Agreement Sponsor agrees to be bound by the MADD Southern California Sponsorship Terms and Conditions, attached and incorporated herein, as well as all additional terms and conditions set forth in the MADD Southern California Sponsorship Proposal, including but not limited to the benefits related to each sponsorship level, which is hereby incorporated in this Agreement. Payment and Benefits Terms The parties agree that Sponsor’s payment to MADD at the level indicated above must be submitted to MADD no later than 60 days fol- lowing the Effective Date of this Agreement. The parties further agree that if Sponsor receives any or all of the benefits that Sponsor shall be entitled to per this Agreement prior to submitting its required sponsorship payment in full, Sponsor shall be obligated to pay to MADD the fair market value of the benefits received by Sponsor. NOTWITHSTANDING ANY OTHER TERMS OF THIS AGREEMENT, SPONSOR SHALL PAY TO MADD THE FULL AMOUNT OF ITS SPONSORSHIP OBLIGATION NO LATER THAN 30 DAYS PRIOR TO THE SPONSORED EVENT. MADD STATISTICS

NO MORE VICTIMS. Simply put, that’s why Mothers Against Drunk Driving was founded. That’s why we exist today. And that’s our hope for the future. On the road of life, we want every family to be safe without the threat of drunk or drugged driving. And we want every family to stay whole without the danger of underage drinking consequences. Our work is preventing the 100% preventable. But sadly, more than 300,000 innocent people are killed or injured on our roadways every year. Countless more are changed forever, yet find comfort, and even- tually hope, through our free victim services. MADD won’t stop until drunk driving does—because one empty seat at the table is one too many. With your help we will arrive at a destination of zero deaths and injuries. Together we will see our dream come true of No More Victims.

 In the United States, the number of drunk driving deaths has been cut in half since MADD was founded in 1980.  Teen alcohol use kills 4,300 people each year – that’s more than all illegal drugs combined.  Someone is killed by a drunk driver every 52 minutes.  In the United States an average of 10,000 lives per year are lost to Drunk Driving.  Drunk driving costs the United States $132 billion a year.  MADD has helped save nearly 30,000 young lives through passage of the 21 minimum drinking age law.  1.77 million attempts to drive drunk at .08 BAC or above that were prevented by ignition interlock devices.  Over 200,000 parents and teens are educated annually on the facts about underage drinking.  MADD educates over 200,000 first time and repeat offenders annually.

TERMS AND CONDITIONS

OUR MISSION Indemnity. Sponsor agrees to indemnify, hold harmless and, at MADD’s request, defend MADD and its directors, officers, employees, and agents against losses and expenses of any nature (including but not limited to reasonable attorneys’ fees and costs of suit) resulting from the performance of this Agreement and that are directly attributable to the gross negligence or willful misconduct of Sponsor, its employees or other representatives. Event Cancellation. MADD will use its commercially best efforts to conduct the Event on scheduled date; however MADD, its directors, officers, employees, and agents shall not be responsible for damages that result from delays or postponements of the Event due to circumstances beyond its reasonable control. In the event that the Event does not take place, Sponsor ’s contribution set forth above shall be treated as a donation to MADD and shall not be refunded. It is mutually understood that MADD is a tax-exempt entity under Section 501(c)(3) of the internal revenue code and that this Agreement and any additional terms and conditions set forth in the MADD Southern California Sponsorship Proposal, including but not limited to the benefits related to each sponsorship level, hereto will not include any obligations for MADD that are unrelated to its charitable purpose or that would subject any payments, donations (in-kind or otherwise) or other valuable consideration made or provided to MADD under this Agreement to tax as income from a business activity unrelated to said charitable purpose. (b) Sponsor represents and warrants that there is no known legal impediment to the use of the Sponsor’s name, logos, or marks as contemplated in this agreement. Sponsorship Payment and Benefits. (a) The parties agree that Sponsor’s payment to MADD at the level indicated above must be submitted to MADD no later than sixty (60) days following the Effective Date of this Agreement. The parties further agree that if Sponsor receives any or all of the benefits that Sponsor shall be entitled to per this Agreement prior to submitting its required sponsorship payment in full, Sponsor shall be obligated to pay to MADD the fair market value of the benefits received by Sponsor. NOTWITHSTANDING ANY OTHER TERMS OF THIS AGREEMENT, SPONSOR SHALL PAY TO MADD THE FULL AMOUNT OF ITS SPONSORSHIP OBLIGATION NO LATER THAN THIRTY (30) DAYS PRIOR TO THE SPONSORED EVENT. Term. This Agreement shall begin on the Effective Date set forth above and end at the conclusion of the scheduled MADD Southern California event (the “Event”). Use of Sponsor Marks. Sponsor grants Mothers Against Drunk Driving (“MADD”) a non-exclusive, royalty free license to use the Sponsor’s name, logos, and marks (“Sponsor Marks”) as approved by Sponsor, as mutually agreed upon, and for no other purpose. Use of MADD Marks. MADD grants Sponsor a non-exclusive, royalty free license to use the MADD name, logo, and marks (“MADD Marks”) as approved by MADD, solely for display in connection with Sponsor’s sponsorship of the Event, or as other-wise mutually agreed upon by MADD and Sponsor, and for no other purpose. Assignment and Sublicense. (a) MADD shall not sublicense or transfer the use of the Sponsor Marks to any person or entity, or otherwise permit a third party to use Sponsor Marks for any purpose not authorized by this Agreement. MADD recognizes that there is great value to Sponsor in the Sponsor Marks and in the good will associated therewith; that nothing in this Agreement gives MADD any interest or property rights in the Sponsor Marks, except the right to use the Sponsor Marks as specifically set forth herein. Governing Law. This Agreement shall be governed, construed and enforced in accordance with and subject to the laws of the state of Texas, except that any conflict of laws rule of Texas that may require reference to the law of some other jurisdiction other than Texas law shall be disregarded. Entire Agreement. This Agreement and any additional terms and conditions set forth in the MADD Southern California Sponsorship Proposal, including but not limited to the benefits related to each sponsorship level, contain the entire agreement between the parties hereto and supersedes any and all prior agreements, arrangements or understandings between the parties relating to the subject matter of this Agreement. No oral understandings, statements, promises or inducements contrary to the terms of this Agreement exist, and each party hereto expressly disclaims reliance upon any facts, promises or representations made by any other party, or its agents, services or attorneys, prior to the date of execution of this Agreement. This Agreement cannot be amended, modified, altered or qualified except by a subsequent agreement in writing personally signed by all parties hereto.
