The Second Circuit determined that simply dividing pre-shift and post-shift work into small tasks that could be deemed de minimis did not render the work not compensable. For these reasons, the Second Circuit affirmed the jury ’ s verdict on the grounds that no reasonable jury could have found for the defendant under any permissible framing of the de minimis inquiry. Top FLSA / Wage & Hour Class And Collective Settlements In 2023 In 2023, the top ten wage & hour settlements totaled $742.5 million, and nine of the ten settlement emanated from litigation in California.
