jurisdiction, reservation status, the protection of federal law and treaties, including restriction on alienation, and pre-emption of state and local taxes and state law that would interfere with Native self-determination and sovereignty; and WHEREAS , the Secretary of the Interior recently reissued updated Federal Indian trust regulations, 25 CFR Part 151, which provide for the recovery of Native lands in the name of the United States of America for the benefit of Native Sovereign Nations, yet do not allow for the recovery of Native home lands in restricted fee status in the name of our Native Nations. NOW THEREFORE BE IT RESOLVED that the Indian Gaming Association calls upon the President and Congress of the United States to enact legislation to further our nation-to-nation treaties and protect our Native Sovereign Nation homelands through provisions for: ● Issuance of Native Nation Restricted Fee Title to Protect Nation homelands with the status of Indian country, subject to the restriction that the land may not be alienated without consent of both the Native Nation title holder and the U.S. Congress; ● Affirmation that our Native homeland is under Native Nation self-government, including civil and criminal jurisdiction, is part of our Native Sovereign Nation reservation as the permanent home thereof, and is protected by Federal laws and treaties safeguarding Indian lands, including any and all protection for Indian trust lands and at the election of the Native Nation title holder, treatment as a Federal enclave; ● Pre-emption of state and local taxation, and pre-emption of state law or regulations that may interfere with Native Sovereign Nation self-determination and self-government; BE IT FURTHER RESOLVED that Native Sovereign Nation restricted fee title should be available for Native Sovereign Nations for protection of sacred sites, permanent homelands, housing, education and health care, agriculture, economic development, and community needs, and that Congress should create a process for transferring Indian trust lands to the status of restricted fee lands, so that Native Sovereign Nations may hold Native lands in our own names and protect our Native lands as the permanent self-governing homelands of our Native Peoples today and for our future generations; and BE IT FINALLY RESOLVED , that this resolution shall be the policy of Indian Gaming Association until it is withdrawn or modified by subsequent resolution.
