3/14/19 CJDBA Authorized Persons on School Buses The only persons authorized to board a school bus operated by the District are students, persons employed by the District, or persons volunteering as participants in school activities. Unauthorized Entry on School Bus Unauthorized entry of a school bus occurs in any of the following circumstances: 1. An individual enters a school bus with the intent to commit a criminal offense. 2. An individual enters a school bus and disrupts or interferes with the driver. 3. An individual, other than (a) a peace officer acting within the scope of his or her authority, or (b) an authorized person (see above), enters a school bus and refuses to leave after being ordered to do so by the driver, and either (a) causes or attempts to cause a disruption or an annoyance to any passenger on the bus, or (b) is reckless as to whether the person’s presence or behavior will cause fear on the part of any passenger on the bus. Utah Code § 76-9-107(2) (2003) Posting of Warning Each school bus shall have a clearly legible sign placed by each entrance to the bus which warns that unauthorized entry of a school bus is a violation of state law. The operator of a school bus shall operate alternating flashing red light signals at all times when children are unloading from a school bus to cross a highway, or when a school bus is stopped for the purpose of loading children who must cross a highway to board the bus, or at any other time when it would be hazardous for vehicles to proceed past the stopped school bus. The alternating flashing red light signals may not be operated except when the school bus is stopped for loading or unloading school children or for an emergency purpose. Utah Code § 41-6a-1302(4) (2015) Standards for Utah Buses and Operations, p. 76 (2004) The flashing yellow lights shall be displayed by the school bus operator at least 100 feet, but not more than 500 feet, before every stop at which the alternately flashing red lights will be actuated.
