Benefited employees who leave the district without retiring, will have their sick days reinstated, in full, if they resume benefited employment with the district within 5 years of leaving. Employees are permitted to use sick leave for: 1. Personal illness 2. Death of an employee’s spouse, child, parent, brother, sister, son-in-law, daughter-in-law, parents-in-law, brother-in-law, sister-in-law, grandparents, grandparents-in-law, grandchildren, aunts, and uncles or significant other as approved by the building principal and/or the Superintendent. 3. For emergency situations involving employees spouse, children, parents, or parents-in-law for the following reasons: a. Hospitalization b. Serious illness c. Medical treatment d. Legal commitment (other than jury duty or guard duty) i.e. subpoenaed to court. 4. Benefited employees may request up to twenty (20) days additional sick leave for newborn baby care. All accrued personal days must be used before this leave can be granted. Accrued sick leave may be saved for future needs. All costs incurred by this leave will be paid by the employee through an actual substitute cost reduction in salary.

3.0411.03 FAMILY LEAVE Issue Date: 9/12/96 Updated: 11/14/19

The District will allow leave for eligible employees as defined in the Family Medical Leave Act (FMLA) of 1993. FMLA requires covered employers to provide up to 12 weeks of unpaid, job-protected leave to “eligible” employees for certain family and medical reasons. Employees are eligible if they have worked for a covered employer for at least one year and for 1,250 hours over the previous 12 months, and if there are at least 50 employees within 75 miles.

3.0411.04 REASONS FOR TAKING FAMILY LEAVE Issue Date: 9/12/96 Updated: 11/14/19

Unpaid leave must be granted for any of the following reasons: 1. To care for the employee’s child after birth, or placement for adoption or foster care, to care for the employee’s spouse, son or daughter, or parent, who has serious health condition 2. For a serious health condition that makes the employee unable to perform the employee’s job. At the employee’s or employer’s option, certain kinds of paid leave may be substituted for unpaid leave.
