Fundamental considerations on gaming and morality
This issue of the IMGL Magazine features several articles that raise fundamental considerations in relation to gaming. These questions concern some of the classic topoi that gaming law authors have long wrestled with. Much legal furor has been generated by Kalshi and other platforms. Are they offering an opportunity to hedge against losses or is this sports betting in different clothing? In his thoughtful article, Aaron Brogan addresses predication markets, which leads almost naturally to the question of whether they involve gambling. Brogan makes the point that, normatively, definitions of prediction markets can encompass gambling, and vice versa, definitions of gambling can encompass prediction markets. In his view, this normative question leads to a dead end and legislators should rather focus on the desired outcomes instead. This perspective reminds me of the moral theory of Utilitarianism
shaped by Jeremy Bentham and John Stuart Mill. By excluding prediction markets from gambling regulation (and thus avoiding their prohibition) Brogan hopes to achieve the greatest number of good outcomes for the greatest number of people. Tony Cabot’s article is not concerned with defining gambling or prediction markets. It outlines the dark side of the casino industry. In his research, Cabot identified failures in the casino industry and traced them back to criminal origins in the Chinese Triads. He makes the point that gaming law alone cannot do the job; it also takes a robust moral compass by gaming law practitioners, among others, to achieve the legislative goals. We use Tony Cabot’s article to introduce a new format to the IMGL Magazine. A book review combined with an open editorial, specifically composed for the IMGL Magazine by the author of the book.
