Also, could EWA deductions from payroll constitute illegal wage deductions? EWA proponents argue that since the wages were already received in advance, and the employees voluntarily agree to any additional deductions, the payroll adjustment is merely a reconciliation of funds already paid. But state laws covering this issue vary. The Future State Improvements in financial transaction technology will continue to allow third-party EWA providers to have a place in supplementing the normal pay day. But are they not akin to the hybrid before the electric car? Pro-rating of deductions can be programmed into any standardized payroll service provider offering. Technology allows the EWA/on-demand pay option—among other pay options—to be incorporated into pay systems. Only the level of employer desire to allow the feature, and employee demand, will determine when this will happen.
EWA table stakes for employers to successfully recruit and retain the newer generations of workers. However, as the definition of EWA has broadened, the distinction between models is becoming a point of legal contention. New York lawsuits targeting both MoneyLion (non-integrated) and DailyPay (integrated) on the same day, allege that both their programs are loans, and the fees, if converted to interest rates, would exceed the amount allowed by state law. DailyPay reportedly defended its model by distinguishing it from direct-to-consumer programs and citing the December 2025 federal shift that favors categorizing integrated EWA as a non-loan, according to the publication Payments Dive . Other Compliance Concerns Payroll professionals also seek clarity on two other issues: If EWA amounts are considered “wages,” and the volume of EWA payouts is high enough, they could trigger a faster schedule for employment tax remittances than the normal pay day.
