Areas, the Stormwater or Surface Water Management System, any Association property, and the Association generally.

(d) The Association shall operate, maintain, and manage the Stormwater Management System(s)in a manner consistent with the requirements ofthe Permit and applicable District rules, and shall assist in the enforcement ofthe restrictions and covenants contained herein. (e) The Association shall levy and collect adequate Assessments (e.g., Annual Assessments and Special Assessments) against Members of the Association for the cost of maintenance,operation, and replacement ofthe Stormwater Management System. The Assessments shall be used for the maintenance and repair of the Stormwater Management Systems and mitigation or preservation areas, including but not limited to work within retention areas, drainage structures and drainage easements. (f) In the event of termination, dissolution or final liquidation of the Association,the responsibility for the operation and maintenance ofthe Stormwater Management System must be transferred to and accepted by an entity which complies with Rule F.A.C., and Applicant's Handbook Volume I, Section 12.3, and be approved by the District prior to such termination, dissolution or liquidation. (g) Existence ofthe Association shall commence with the filing the Articles with the Secretary of State, Tallahassee, Florida, and the Association shall thereafter exist in perpetuity. However, if the Association is dissolved, the Stormwater Management System, any property containing the Stormwater Management System, and all water management portions of Common Areas, shall be conveyed to an entity meeting the requirements ofsubsection(c)directly above. (h) As provided elsewhere herein, this Declaration shall run with and bind and benefit the Property for a term of thirty (30) years from the Effective Date, after which time this Declaration and each Supplemental Declaration shall be automatically extended for successive periods of ten(10)years, unless prior to the commencement ofany 10-year extension period an instrument properly executed and signed by the Owners of eighty percent(80%)of the Lots and agreeing to terminate this Declaration is Recorded in the Public Records. (i) A "Recorded Notice of Environmental Resource Permit," Form No. 1), shall be Recorded in the Public Records. IfRules are promulgated a copy ofthe Permit shall be attached to said Rules as an exhibit. The Registered Agent for the Association will maintain a copy of the Permit and copies ofall further permitting actions for the benefit ofthe Association.

Section 10.02. Ownership/Control, Maintenance, and General Use of Stormwater Management System.

(a) The Association owns the Stormwater Management System. The Stormwater Management System is located on land that is designated as Common Area, is located on land that is owned by the Association, or is located on land that is subject to a perpetual easement in favor of the Association and its successors such that the Association has the perpetual right to operate and maintain the Stormwater Management System. (b) The Association shall be responsible for the maintenance, operation and repair ofthe Stormwater Management System. It is the responsibility of the Association to operate and maintain the Stormwater Management System. Maintenance of the Stormwater Management System(s) shall mean the exercise of practices which allow the systems to provide drainage, water storage,
