WHAT IS ‘RECKLESS DRIVING’? If a driver engages in any of the following on the road and by doing so endanger the lives of others, they could be cited for reckless driving:

• • • •

Extreme Speeding

Tailgating

Aggressively passing other cars Sharp, dangerous turns leaving no room for other vehicles Not yielding the right of way on a highway

While reckless driving doesn’t necessarily mean losing your license, you must tread carefully. If you are accused of reckless driving, you must know your next steps to protect your license and avoid charges and fines.

IF YOU’RE CITED … Stay calm and compliant.

The first and most crucial step is to remain calm and cooperative at the scene. Arguing with law enforcement or becoming defensive can only worsen the situation. Following the officer’s instructions and providing the necessary documentation, such as your driver’s license, vehicle registration, and proof of insurance, are essential. Remember, your behavior during the stop can be taken into account later. Gather evidence. If you believe the reckless driving accusation is unjust, gather evidence as soon as possible. This can include photos of the road conditions, weather reports, and witness statements. If your truck has a dashcam, ensure you save and secure footage that could help your case. Documentation from your Electronic Logging Device (ELD) can also provide critical information about your driving speed and behavior at the time of the alleged offense. Consult a traffic law attorney. Consulting with a traffic law attorney who specializes in cases involving commercial drivers is imperative. An experienced lawyer can help you understand the charges against you, the possible defenses, and the potential impacts on your commercial driver’s license (CDL) and employment. They can also represent you in court, negotiate with prosecutors, and work to minimize the penalties or possibly get the charges dismissed.
