Bair Hugger Victims Get Their Day in Court U.S. Court of Appeals Reinstates Lawsuits Against 3M The lawyers at Cellino Law continue to battle major manufacturers on behalf of individuals injured by defective medical products. One such litigation is against 3M company for its Bair Hugger warming device. The 3M Bair Hugger device was developed in the 1980s to keep patients warm during surgery by circulating warm air around them. Orthopedic surgeries involving implants are prone to infection, and the standard of care is to perform those surgeries in an “ultra-clean” operating room with a cold environment and HEPA filtration. Experts determined that the Bair Hugger device can carry bacteria to the surgical site, both through the warm air generated and contamination to the machine itself. Some studies suggest patients warmed by the Bair Hugger device were nearly four times more likely to develop a post-operative joint infection. In fact, the inventor of the device concluded that the Bair Hugger is defective and developed a new warming device that uses direct warming contact instead of blowing potentially contaminated hot air in the operating room. Nevertheless, 3M continued to market, support, and sell the Bair Hugger device. Cellino Law represents several clients who all developed joint infections following the use of the Bair Hugger device. Cases from across the country were consolidated in federal court in Minnesota, and 3M aggressively fought each and every claim. In 2019, 3M was successful
in blocking all cases, convincing the presiding judge that there was not enough evidence the Bair Hugger was defective. Our fight was far from over, and all cases were appealed. On Aug. 16, 2021, the higher court reinstated thousands of lawsuits against 3M, citing wrongly excluded testimonies from experts on the dangers posed by the device. Those injured by the Bair Hugger device can finally move toward their day in court. As with most litigation against huge corporations with unlimited resources, the fight for justice can be long and difficult. Ingredients
• 1 tbsp vegetable oil • 4 Italian chicken sausages, sliced to bite-size pieces • 6 cloves garlic • 1 onion, chopped • 6–7 cups butternut squash, peeled and cubed
• Salt and pepper, to taste • 4 cups chicken broth • 1 tsp smoked paprika • 1 tsp Italian seasoning • 3 cups kale, chopped • 1 tbsp red wine vinegar
Directions
1. In a large pot, heat oil over medium heat. Add sausage and cook 4–5 minutes, stirring often, then remove from the pot and set aside. 2. Add garlic and onion to the pot. Sauté 4–5 minutes. Add squash, salt, and pepper. Sauté 8 minutes. 3. In a slow cooker, combine sautéed vegetables, sausage, chicken broth, and seasonings. Cook on low heat for 3 hours and 30 minutes. 4. Open the pot and add the kale. Cook another 20 minutes, then add the red wine vinegar and stir to combine. Cook 10 more minutes, then serve and enjoy!
