METHOD AND TERMS

The Fox Family Farms will be sold in seven individual tracts. Tract 1 & 2 will be sold first on a price per acre basis, based on a survey that is currently in progress. Tract 3 will be sold next for a lump sum total dollar amount. Tract 4 will sell next, followed by Tract 5 and both will be offered on a price per acre basis, based on taxable acres. Tract 6 will be sold next for a lump sum total dollar amount, followed by Tract 7, also selling for a lump sum total dollar amount. The farms will nOT be offered in their entirety at the conclusion of the auction. Bidding is nOT contingent upon financing. Immediately following the auction, the winning bidder(s) will be required to sign a real estate sales contract and pay ten percent (10%) of the purchase price as a non-refundable down payment, payable to Mcnamara, Reinicke, Vogelsberg & Helmke, LLP. The balance of the purchase price will be due at closing which will take place on Tracts 1, 2, 3, 4, 6 & 7 on or before June 1, 2018. Closing on Tract 5 will be held on or before July 1, 2018. Possession will be given at time of closing, with immediate possession given on the tillable acres on all tracts upon proof of sufficient liability insurance. The real estate taxes will be prorated to the date of closing. Title Insurance in the full amount of the purchase price will be provided by the seller. All announcements made sale day take precedence over prior advertising either written or oral. SPECIAL PROVISIONS

• This real estate is being sold subject to public road easements and all other easements of record. • Fences and fence lines shall be governed by the State of Wisconsin and the Grant County fence line rules and regulations. • It will be the responsibility of the new buyer(s) to show proof of purchase to the Grant County FSA Office so that he/she will receive all future government payments. • All personal property on all tracts are being reserved for the owners and tenant, including bulk bins on Tract 1, the Knight mixer, all feed products, bulk bins, chicken house and other personal property on Tract 5. • The hauling and dispensing of manure on Tract 5 will be determined between the buyer(s) and the tenant on Tract 5. • If in the future a site clean up is required, it will be at the expense of the buyer(s).
