METHOD & TERMS

the acres listed in this brochure are estimated. A survey is underway and will be completed prior to the auction. the surveyed acres will be used to constitute the final settlement price. tracts 1 - 8 will be offered through the marketing method of "buyer's Choice," whereas the high bidder can purchase (in any order) any or all tracts for their high bid. “buyer’s Choice” auctioning will continue until the first 8 tracts have been elected. tract 9 will then be sold for a “lump sum” total dollar amount. After all tracts have been sold, they will not be offered in their entirety based on the cumulative price the individual tracts achieved. ten percent (10%) of the bid price will be due on the day of the auction, with the balance due in approximately 45 days, on or before tuesday, January 31st, at the time of closing. title insurance in the full amount of the purchase price will be provided by the seller. the 2016 real estate taxes, due and payable in 2017, will be paid by the seller. Possession will be given at the time of closing on all tracts. All tracts sell free & clear of any farm or hunting tenancies for the 2017 year. All announcements sale day shall take precedence over any prior advertising either written or oral. the information in this brochure is believed to be accurate; however, no liability for its accuracy, errors or omissions is assumed. All lines drawn on maps, photographs, etc. are approximate. buyers should verify the information to their satisfaction. there are no expressed or implied warranties pertaining to the property. this real estate is being sold “as is”. SPECIAL PROVISIONS • this real estate is being sold subject to public road easements and all other easements of record. • it will be the responsibility of the new buyer(s) to show proof of purchase to the Rock island County fSA office so that he/she will receive all future government payments. • there are several environmental monitoring wells on the ellis property. they are located on tracts 6, 8 & 9. Some wells are monitored twice per year and others quarterly. they serve to confirm the extent of impacted groundwater is limited. Monitoring is required going forward for an undetermined period of time. there is also an underground storage tank on tract 8. • if in the future a site clean up is required, it will be at the expense of the buyer(s).
