TERMS & CONDITIONS

1. All horses in this sale are offered according to the laws of the State of Iowa and all transactions between the buyer, consignor, and Heartland Select Performance Horse Sale will be governed by the laws of the State of Iowa. 2. The highest bidder shall be the buyer. If a dispute arises between two or more bidders, the horse in dispute shall immediately be put up again for advance bids. If there is no advance bids, the horse will be sold to the person from whom the auctioneer recognized as having the last bid. Bids received after the fall of the hammer are not grounds for dispute. Bids acknowledged by bid spotters are recognized as if tendered to auctioneer. The auctioneer reserves the right to reject any and all bids. 3. Terms of the sale are cash, cashier ’ s check or personal check accompanied with a letter of credit, no exceptions. Driver ’ s license or some other form of positive identification will be required for check. Payment in full must be made to the cashier immediately after the sale. Make settlement with the cashier of Heartland Select Performance Horse Sale. Payment to others, including consignors or their representatives, is not recognized as settlement. 4. Upon receiving payment for a horse, the cashier will issue an order to obtain delivery. Buyers are cautioned not to lose these orders. 5. Title passes at the fall of the hammer, at which time the buyer assumes all risks and responsibilities for the horse, and such constitutes delivery of the animal, which shall be contingent upon buyer presenting himself to the cashier to make settlement. The buyer agrees to indemnify and hold the consignor and Heartland Select Performance Horse Sale harmless from all loss, cost and expense arising from the illness, injury or death of persons caused by the buyer, the buyer ’ s agents or employees, or by the animal

subsequent to the time of purchase. 6. All transfers will be filled out in full.

7. All expenses relating to the horse incurred by Heartland Select Performance Horse Sale after the hammer falls will be paid by the buyer. All court costs, filing fees, expenses of collection and all expenses of insuring, maintaining, transporting or reselling any animal incurred by the consignor arising from the buyer ’ s default will be paid by the buyer. 8. The sale management and auctioneer do not act as agents for or represent either buyer or seller, but merely provide a medium for bringing together buyer and seller for the purpose of sale transactions.
