METHOD & TERMS - REAL ESTATE
All 3-tracts will be surveyed. Tracts 1 & 2 will be sold by the acre, based on the acreages obtained from the survey, and offered through the marketing method of “Buyer’s Choice”, whereas the high bidder can purchase either Tract 1, or Tract 2 or both tracts for their high bid. If the high bidder does not take both tracts, then the remaining tract will be offered. We will then sell Tract 3 for a lump sum or total dollar amount (not by the acre). The tracts will NOT be offered in their entirety at the conclusion of the auction. Immediately following the auction, the successful buyer will be required to sign and enter into a written real estate sales contract, and pay ten percent (10%) of the purchase price as a non-refundable down payment which will be held in escrow until closing. The balance of the purchase price will be due at closing which will take place on or before September 1, 2023. The Seller will provide title insurance in the full amount of the purchase price, and pay the 2022 real estate taxes (due and payable in 2023). The seller will pay the 2023 real estate taxes on Tracts 1 & 2. The real estate taxes on Tract 3 will be prorated to the date of closing. Possession will be given at the time of closing, subject to the farm lease for 2023 crop year only. Seller to retain all farm income for 2023. Bidding is NOT subject to any contingencies, including but not limited to financing, an appraisal or inspection of the property. All announcements made sale day take precedence over prior advertising either written or oral.
