• Harrell’s Coating Solutions employees are paid for twelve (12) hours of Holiday Pay at their regular straight-time rate, including shift differential if scheduled to work and eight (8) hours of Holiday Pay at their straight-time rate if they are not scheduled to work. When one of the holidays falls on a Saturday, it is observed the preceding Friday; when it falls on a Sunday, it is observed the following Monday. The Company reserves the right to close on another day or grant compensating time off instead of closing its offices. To receive holiday pay, an employee must work the day before and the day after a holiday unless the day before or the day after is a commonly designated day off, the employee is on a company- approved leave of absence, or the employee has a doctor's note excusing the absence. JURY DUTY / SUBPOENAED WITNESS LEAVE Jury Duty is a civic responsibility and may require some time away from the Company. All employees who have been summoned for jury duty or are subpoenaed as a witness will be allowed whatever time off that is required to serve. Any employee summoned to serve as a juror or subpoenaed to appear as a witness must notify their supervisor upon receipt of such summons or subpoena and, to the extent possible, keep in touch with their supervisor during the time the employee is serving as a juror or appearing as a witness. Any employee who serves as a juror or appears as a witness pursuant to a subpoena will be permitted to return to the same employment they held when summoned or subpoenaed unless circumstances have changed while the employee was serving so that reemployment is impossible or unreasonable. An employee intending to return to Harrell’s following jury service or appearance as a subpoenaed witness must, as soon as practical after release from jury service or subpoena, give the Company actual notice that the employee intends to return. The employee must provide Harrell’s with documentation from the court or other tribunal concerning the actual dates and times of such employee’s service or appearance. Harrell’s will pay the employee’s base pay for up to ten (10) days for Regular Full-Time Employees. Any time served beyond ten (10) days will be an unpaid leave of absence. To receive pay for Jury Duty Leave, an employee must provide their supervisor with a statement issued by the Court indicating their notification of jury duty within two weeks of receiving that notice. The employee will be required to return to work on those portions of a day in which they are not required to appear in court. Note, however, that exempt employees shall receive their full weekly salary for any week in which they perform any work and serve on a jury or as a subpoenaed witness. An employee’s time as a juror or witness will not count toward hours worked for pay, overtime, or vacation accrual. An employee wishing to take time off to appear voluntarily as a witness or party to any litigation or other judicial, legislative, or administrative proceeding must obtain the written approval of their supervisor. The employee will be required to use any available vacation or to obtain approval for a leave of absence without pay. In the event an employee appears as a witness or attends court proceedings at the request of Harrell’s, such time will be considered hours worked for all purposes, and provisions of this policy will not apply.
