STANDARDS OF CONDUCT All employees are expected to conduct themselves professionally and behave in a manner conducive to the efficient and safe operation of the Company. An employee’s behavior and conduct reflect on the Company and impact the success of its business. Employees who engage in misconduct or whose performance is unsatisfactory may be subject to disciplinary action, at the sole discretion of Harrell’s, even for the first offense, including suspension, termination, or other disciplinary action. The prohibited conduct listed below is not an all-inclusive list. This policy is not intended to limit the Company’s right to discipline or discharge employees for any appropriate reason. In fact, while Harrell’s values its employees, the Company retains the right to terminate an employee on an “at-will” basis, meaning at any time, with or without notice and with or without cause. 2. Possessing, using, distributing, selling, negotiating the sale of, or being under the influence of alcohol, drugs, or other controlled substances during working hours, on company property (including company vehicles), in company uniform, or on company business. 3. An employee inaccurately reporting the number of hours they worked or any other the hours of any other employee. 4. Falsification of any employment-related document including, but not limited to, job applications, personnel files, employment review documents, intra-company communication, communications with those outside the Company, or expense records. 5. Theft or destruction of company property or that of visitors, clients, or fellow employees. 6. Fighting with or harassment of any fellow employee or customer. 7. Unauthorized or excessive use of company property or the property of any visitor, customer, or fellow employee. This includes but is not limited to vehicles, supplies, telephones, cellphones, mail, and computers. 8. Disclosure of company trade secrets or any other confidential or proprietary information about the Company, its customers, or fellow employees. 9. Insubordination, including but not limited to any refusal to perform a requested or required job task. 10. Failure to follow safety rules and procedures. 11. Excessive tardiness or absences. 12. Three (3) consecutive days of No call No, show. 13. Smoking in non-designated areas. 14. Working unauthorized overtime. 15. Solicitation of fellow employees on the Company premises during working time. 16. Failure to dress appropriately. 17. Use of obscene or otherwise inappropriate language or conduct in the workplace. 18. Failure to provide timely medical authorizations for medical absences that are longer than three days. 19. Inappropriate horseplay that distracts fellow employees or creates a danger to others. 20. Criminal activity at or outside of the workplace. 21. Outside employment which interferes with the employee’s ability to perform their job at Harrell’s. 22. Gambling on company premises. 23. Sleeping on the job or neglecting job duties. 24. Taking unauthorized gratuities in connection with company business. Examples of inappropriate conduct include, but are not limited to: 1. Violation of the policies and procedures outlined in this handbook.
