Bill Summaries: Livable Communities

Use of Wireless Communications Devices While Driving CS/CS/SB 90, by Senator Perry, FAILED. The companion bill was CS/CS/HB 33, by Representatives Toledo and Slosberg. AARP supported this legislation. The “Florida Ban on Texting While Driving Law” (TWD) prohibits a person from texting, emailing and instant messaging while driving, but the ban can only be enforced as a secondary action. This means an officer must cite a driver for another traffic offense in order to cite the driver for TWD. The legislation would have changed TWD to a primary offense, which means an officer would be able ticket a driver solely for TWD. It would have required law enforcement officers to record the race and ethnicity of a person issued a citation for TWD. See Voting Record for CS/SB 90 p.69; CS/CS/HB 33 p.70. Affordable Housing CS/CS/CS/HB 987, by Representative Cortez (B), FAILED. The companion bill was SB 1328, by Senator Perry. AARP monitored this legislation. The legislation would have created new requirements for use of local and state government-owned surplus land, for assessment of impact and mobility fees by local government entities and for “permitting” by local government for affordable housing. The legislation would have prohibited the Legislature from sweeping affordable housing funds for use on other budgetary purposes. See Voting Record for SB 874 p.74.
