J. Final PUD Plats. 1. Procedures. When all, or a phase, of an approved Preliminary PUD Plan is ready for development, the developer must follow Subdivision Regulation procedures for submitting a F inal Plat . a. See Subdivision Regulations, Sections 6-100 through 6-106 for Final Plat. b. See Subdivision Regulations, Article 7, for Required Improvements. 2. Contents of Final PUD Plat. a. A Final PUD Plat must contain all the contents required for a Final Plat , as shown in Section 6-108 of the Subdivision Regulations. b. In addition to the contents required for a Final Plat, a Final PUD Plat must also: (1) Describe how the Final PUD Plat conforms with the Comprehensive Plan . (2) Specify zoning provisions that apply in the PUD Overlay District.
3. Substantial Compliance. In order to approve a Final PUD Plat, the Planning Commission must determine that the Final PUD Plat substantially complies with the Preliminary PUD Plan . a. To substantially comply with the Preliminary PUD Plan, proposed modifications must not substantially : (1) Affect the location or design of streets, or of facilities related to stormwater drainage, water supply, or sewage disposal. (2) Reduce the area set aside for common open space. (See definition of COMMON OPEN SPACE.) (3) Vary the proposed gross residential density or intensity of use by more than 5%. (4) Increase the total ground area covered by buildings by more than 5%. (5) Increase the floor area proposed for nonresidential use by more than 10%. (6) Change building heights by more than 5%. b. The developer is responsible for showing good cause to the Planning Commission for any variation between the approved Preliminary PUD Plan and the submitted Final PUD plat. c. In order to meet requirements for substantial compliance, the developer has the option to pursue an amendment to the Preliminary PUD Plan. 4. Governing Body Action on a Final PUD Plat must follow the procedures described in Subdivision Regulations, Section 6-104.
(3) Specify the extent to which zoning provisions for each parcel within the Final PUD Plat have been varied or modified from the provisions of the underlying zoning district. (4) Provide evidence that any applicable restrictive covenants were recorded prior to conveyance or lease of any lot, parcel, tract or dwelling unit in the development. (5) Provide proof of establishment and activation of any entity that is to be responsible for management
and maintenance of common open space. (See definition of COMMON OPEN SPACE.)
