B. Definition of Home Occupation: A business, profession, occupation, or trade, undertaken for gain or support, and conducted entirely within a residential building or manufactured/mobile home, or within a permitted structure accessory to such a building or home. 1. Exemption: This definition exempts gunsmithing and sales of firearms and ammunition as home occupations. Such uses are regulated by permit from the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives. a. A sign for such a home occupation may still require a zoning permit. (See Zoning Regulations, Section 8-104B, on exempt signs.) b. Outdoor storage of equipment, materials, vehicles or displays used in the home occupation are not permitted as a residential accessory use. C. Use Limitations. A home occupation must comply with all the use limitations applicable to the district in which it is located, and with the following restrictions: 1. The home occupation must be conducted entirely within the principal residential structure, or a garage, swimming pool, or an accessory structure. 2. The character of the principal residential structure as a dwelling must not be altered. 3. The home occupation must occupy no more than 25% of the gross floor area of the dwelling. a. Exception: Rooms let to boarders and roomers are not subject to this limitation. (See definition of BOARDING HOUSE.)
103 Home Occupations A. Authorization. Home occupations are permitted when incidental to the principal use of a residential building or manufactured/mobile home. 1. The residential appearance of the building or home must be maintained. 2. No undue traffic or parking problems must be created. 3. In a business or industrial district, a home occupation which complies with all the provisions of this section may be conducted as a legal, nonconforming use. 4. In a business or industrial district, a home occupation which meets all the provisions of the zoning district may obtain a zoning permit or an occupancy certificate to operate the property and structures as a permitted use. a. A Zoning permit is required only when an accessory structure is used, or a home occupation sign larger than the exempt size is displayed. (See Zoning Regulations, Section 8-104B, on exempt signs.)
