E. Registration of Nonconformities. Nonconformities may be in effect for many years. Registering a nonconformity provides a property owner with an official record of the nonconformity's legal establishment. 1. The Zoning Administrator will establish a process for registering and keeping records of nonconformities. 2. There is no deadline for registration. However, property owners are encouraged to register nonconformities at their earliest convenience. 101 Nonconforming Lots of Record A. In Any Residential District. In spite of any other provisions of these Zoning Regulations, a single-family detached dwelling or any type of manufactured or mobile home may be located on a nonconforming lot of record which:

B. In Any Nonresidential District. In spite of any other provisions of these Zoning Regulations, a structure designed for any permitted use may be located on a nonconforming lot of record which:

1. Is under single ownership. 2. Is at least 50 feet wide.

3. Complies with all applicable zoning regulations except minimum lot area, width and depth, and minimum side yard requirements. 4. Complies with the following side yard requirement: a. The width of any side yard must be at least equal to (LW × MSY) ÷ MLW , where LW = Actual Lot Width MSY = Minimum Side Yard required by zoning district regulations MLW = Minimum Lot Width required by zoning district regulations 102 Nonconforming Structures A. Authority to Continue. A nonconforming structure may continue to be legally permitted for as long as the structure complies with the following restrictions: 1. Enlargement, Repair or Alterations. A nonconforming structure may be maintained, repaired, enlarged or structurally altered, as long as the changes do not increase the degree of existing nonconformity or create any additional nonconformity in any part of the structure.

1. Is under single ownership. 2. Is at least 50 feet wide.

3. Complies with all applicable zoning regulations except minimum lot area, width and depth, and minimum side yard requirements. 4. Complies with the following side yard requirements: a. The structure must be placed on the lot so as to provide a yard at least 5 feet wide on each side of the dwelling. b. The sum of the widths of the 2 side yards on the lot must be at least: (1) 20% of the width of the lot, or (2) The minimum total for both side yards prescribed by the bulk regulations for the zoning district. c. When a side yard is also considered a front yard on a corner lot , one of the lot's front yards may be reduced to 15 feet.
