B. Issuance. After the effective date of these Zoning Regulations, occupancy certificates must be issued according to the following procedure. 1. An occupancy certificate is required for: a. A structure or addition to a structure, which is constructed, reconstructed, moved or structurally altered, which is occupied or used for any purpose. b. A new or changed use, of any structure or land. c. A new use, for any purpose, of land which is vacant on the effective date of these Zoning Regulations. 2. Before an occupancy certificate is issued, work must be completed, and the Zoning Administrator must inspect the premises and certify that they comply with the plans and specifications submitted with the zoning permit application. a. Work to be completed includes any improvements required by City Subdivision Regulations , for utilities, streets and other public improvements, which must be either installed or guaranteed. (See Zoning Regulations, Section 10-104 on Installation Guarantees for Required Improvements.) b. Direct access must be available from the frontage of each zoning lot to an opened public street. 3. The Zoning Administrator must respond within 10 days after receiving an application, or being notified in writing that the structures or premises are ready for occupancy or use. a. The Zoning Administrator must either issue an occupancy certificate, or provide written notice to the Applicant stating the reasons why a certificate cannot be issued.
C. Temporary Occupancy Certificate. A temporary occupancy certificate may be issued, allowing occupancy before certain elements of the project are entirely completed. (For example, a temporary occupancy certificate may be issued in the winter, pending installation of required landscaping the following spring.) 1. A temporary occupancy certificate may be valid for up to 6 months from the date it is issued , as long as satisfactory guarantees for completion of the work are submitted. a. Satisfactory guarantees may include performance bonds or escrow accounts. (See Zoning Regulations, Section 10-104 on Installation Guarantees for Required Improvements.) 103 Enforcement and Liability A. Enforcement. The Zoning Administrator is responsible for enforcing the provisions of these Zoning Regulations, working in conjunction with the City Attorney. 1. The Zoning Administrator must refuse to issue any zoning permit or occupancy certificate for any building, structure or use which would violate any provisions of these Zoning Regulations. 2. The Zoning Administrator must revoke a zoning permit and issue a stop order for a building, structure or use, whenever: a. There is a departure from the plans, specifications or conditions, as required under terms of the zoning permit. b. The zoning permit: (1) Was obtained by false representation. (2) Was issued by mistake. (3) Violates any provisions of the Zoning Regulations.
