3. The Zoning Administrator must inspect any building, structure, place or premises , or have it inspected, as required by these Zoning Regulations. a. The Zoning Administrator must order in writing that any condition be remedied , which violates or threatens to violate any provisions of these Zoning Regulations. 4. The Zoning Administrator must institute any appropriate action or proceedings to prevent violations of any provisions of these Zoning Regulations. 5. The Zoning Administrator must restrain, correct or abate any violations of any provisions of these Zoning Regulations. B. Liability. The Zoning Administrator or designees charged with enforcing these Zoning Regulations, acting in good faith and without malice in the discharge of the duties described in these Regulations, must not be personally liable for any damage to persons or property that may result from any act or omission which occurs in the discharge of those duties. (See K.S.A. 75-6101 et seq. in general, and K.S.A. 75-6109 specifically.) 1. A suit brought against the Zoning Administrator because of an act or omission performed by the Administrator in the enforcement of any provision of these Zoning Regulations, or other pertinent laws or ordinances implemented through the enforcement of these Zoning Regulations, must be defended by the City. a. The City must defend the suit until final termination of the proceedings. b. Any judgment resulting from the suit must be assumed by the City.
104 Violations A. Violations may occur when any building or structure is erected, constructed, reconstructed, structurally altered, converted or maintained in violation of these Zoning Regulations, or when any building, structure or land is used or is proposed to be used in violation of these Zoning Regulations. B. Violators may include: 1. The owner or agent of a building, structure or premises where a violation of any provision of these Zoning Regulations exists or has been committed. 2. The lessee or tenant of an entire building or entire premises where a violation of any provision of these Zoning Regulations exists or has been committed. 3. The agent, architect, building contractor, or any other person who commits, takes part, or assists in a violation of any provision of these Zoning Regulations. C. Penalties. Any violation of these Zoning Regulations is a misdemeanor . (See K.S.A. 12-761, as amended.) 1. Each offense must be punished by a fine not to exceed $500, or by imprisonment for not more than 6 months, or both. 2. Each day's violation constitutes a separate offense .
