E. Oil Well Drilling and Operation. In spite of any other provisions of these Zoning Regulations, drilling or operation of oil wells may be allowed as a conditional use in all zoning districts. 1. A conditional use permit must be obtained before drilling or operating an oil well in any zoning district. a. Exception: A conditional use permit is not required for drilling or operating an oil well in an industrial district , if the well is more than 500 feet from any school, residential district boundary, or dwelling. 2. Except in industrial zoning districts, all oil well drilling or operations are subject to the following conditions. a. All pumping equipment, stored oil, and stored waste products must be fully enclosed. (1) Enclosures must be compatible in construction and design with the surrounding area. (2) In all residential districts, enclosures must be fully roofed. (3) In nonresidential districts, the BZA may require roofing in order to minimize adverse effects on adjoining properties. b. Except in the case of an emergency, all hauling of oil, water, and other materials must take place during daylight hours. F. Decisions and Records. 1. The BZA must render a written decision on an application for a conditional use in the form of a resolution containing specific findings of fact. a. The resolution must be signed without unreasonable delay, but in all cases within 45 days after the close of the hearing.
2. The Zoning Administrator must maintain complete records of all BZA actions on applications for conditional uses, in order to properly issue zoning permits. G. Period of Validity. A conditional use is valid for a period of 180 days from the date it is granted by the BZA, and the use must be commenced within that period. 1. Extensions. On written application, and without further notice or hearing, the BZA may grant additional extensions. a. Additional extensions may not exceed 180 days each. 108 Appeals A. Appeals. An appeal is an application to the Board of Zoning Appeals to review a Zoning Administrator decision regarding the interpretation, application or enforcement of these Zoning Regulations, on the basis that there has been error in an order, requirement, decision, or determination. 1. An appeal may be filed with the BZA by any person aggrieved, by any officer of the City, or by any governmental agency or body affected by any decision of the Zoning Administrator. 2. An application for appeal must be filed with the BZA within 30 days after the date of the Zoning Administrator decision being appealed. 3. On receipt of an application for appeal, the BZA Chairperson must notify the Zoning Administrator of the appeal without delay. a. When notified of an appeal, the Zoning Administrator must transmit as soon as possible to the BZA Chairperson all documents constituting the record on which the decision being appealed was based.
