H. Zoning Classification of Lesser Change. The Planning Commission may recommend changing the zoning of only a portion of a subject property , or giving all or any part of the property a zoning classification of lesser change than that described in the notice, without republication of a notice or redistribution of notices to property owners . 1. Exception: If the lesser change proposed is to a zoning classification more restrictive than the existing classification , then republication and re-mailing of notices is required. 2. In accordance with provisions of K.S.A. 12-757(c) , a proposed zoning change must be returned to the Planning Commission for reconsideration and further recommendation to the Governing Body, without further publication or notice, if either: a. The Applicant at the Governing Body meeting at which a zoning amendment is being considered wants to amend the application. b. The Governing Body wants to consider a lesser change to the zoning district. 3. The adjacent Table of Comparability for Zoning Districts shows Andover's Zoning Districts in order, from lesser change to greater change. (See K.S.A. 12-757(b).) a. Because of the unique nature and special purposes they serve, the following zoning districts are excluded from the Table of Comparability: (1) A-1 — Agricultural Transition District.

4. The Table of Comparability does not apply to applications for a special use . Reapplication is necessary for consideration of a different use, even if in the same zone. a. Exception: Part of the property considered for a special use may be withdrawn by the Applicant, or a lesser amount recommended for approval, without further publication or notice.
