C. Period of Validity. 1. A special use is valid for a period of one year from the publication date of its effectuating ordinance , unless one of the following conditions applies: a. Another time period is designated, as a condition attached to the special use. b. An application is filed and a zoning permit is approved during the period of validity. (1) The special use is then valid for the zoning permit's period of validity. 2. Extensions. On written request received within a valid period, and without further notice or hearing, the Governing Body may authorize extensions of the validity period. 3. Expiration of Validity Period. Unless an extension has been granted or a zoning permit has been obtained during a validity period, the effectuating ordinance for the special use automatically becomes null and void if any validity period expires. D. Proposing a Special Use. 1. The Planning Commission or the Governing Body may propose special uses. a. Special uses proposed by the Governing Body must be transmitted to the Planning Commission, for a public hearing and recommendation. 2. A property owner may propose a special use for their own property. 3. For special uses proposed by or on behalf of the owner , an application must be filed with the Zoning Administrator. a. The Zoning Administrator will refer the application to the Planning Commission for a hearing.
2. Conditions may include, but are not limited to, requirements affecting: a. Lot size or yard dimensions. b. Lot coverage and height of buildings c. Change to street width. d. Extent and location of entrance or exit drives. e. Size, location and number of signs. f. Period and time of operation. g. Screening, fencing or landscaping to protect surrounding properties. h. Environmental standards for air and water pollution, noise, vibration, lighting and other such conditions. i. Protection from flooding. j. Additional improvements such as street construction, sidewalks, utilities and storm drainage, if necessary. k. Additional platting or dedications. 3. Violation. Failure to comply with any of the conditions attached to a zoning permit for a special use constitutes a violation of these Zoning Regulations. 4. To change a condition of a special use at a later date, an Applicant must apply for a rehearing by the Planning Commission, at which only the condition proposed to be changed will be reconsidered.
