J. Report by Planning Commission to Governing Body. The Planning Commission must submit a report to the Governing Body within 14 days after the close of a public hearing on a proposed special use. 1. The report must contain: a. A summary of the hearing on the proposed special use. b. Determinations on the factors listed in Section 12-101 I of these Zoning Regulations, and on other items the Commission may consider relevant. (1) Include a copy of the Zoning Administrator's Report on factors. c. A recommendation for approval or disapproval of the proposed special use. 2. Copies of the report. a. A copy of the report must be mailed to the Applicant. b. Copies must be filed with the City Clerk and with the Zoning Administrator. These copies must be available for public inspection. 102 Project Review A. Project Review for Conformance with Comprehensive Plan. 1. Before it may be constructed, any public improvement, public facility, or public utility of a type included in Comprehensive Plan recommendations must be submitted to and approved by the Planning Commission as conforming with the Comprehensive Plan. (See K.S.A. 12-748 et seq. ) a. If the Planning Commission finds that a proposed public improvement, facility or utility conforms to the Plan , no further approval by the Planning Commission is necessary.
b. If the Planning Commission does not make a report within 60 days , the project is deemed to have been approved . c. If the Planning Commission finds that a proposed public improvement, facility or utility does not conform to the Plan , the Commission must submit a written report to the Governing Body describing the manner in which it does not conform. (1) The Governing Body must not proceed with construction of such a proposed use unless it overrides the disapproval of the Commission by a majority vote. (2) If the Governing Body overrides the report of the Planning Commission, the Comprehensive Plan for the area concerned is deemed amended , and the Planning Commission must make any necessary changes in the Plan to reflect the vote of the Governing Body. 2. If such public improvements, facilities or utilities are classified as special uses or are the subject of a change in zoning district classification or boundary, the consideration of such uses by the Planning Commission in conjunction with a zoning application may also constitute their project review.
