ARTICLE 13. REVIEWS, SEVERABILITY & EFFECTIVE DATE 100 Annual Review A. In order to maintain the intent and purpose of the Zoning Regulations under changing conditions, and to implement the Comprehensive Plan, the Planning Commission must hold an annual public review to consider revisions or amendments to these Zoning Regulations. 1. The annual Zoning Regulations review may take place at the Planning Commission's first regular meeting in September . 2. In preparation for the annual review, The Zoning Administrator must: a. Notify the City Council, other affected governmental agencies, and interested private organizations and individuals of the Commission's intent to review the Zoning Regulations, and request ideas. b. Provide a record to the Planning Commission of
101 Judicial Review A. Any ordinance, regulation, amendment, special use or other zoning decision provided for or authorized by these Zoning Regulations must be reasonable. (See K.S.A. 12-760 et seq. ) 1. Any aggrieved person may bring an action in the Butler County District Court against the City, to have the reasonableness of a zoning decision determined. a. For an amendment to these Zoning Regulations or a special use approved by the City Council, action must be brought within 30 days after the effectuating ordinance is published. 102 Severability A. If any provision of these Zoning Regulations is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, then the unconstitutional or invalid provision must be considered separately and apart from the remaining provisions of these Zoning Regulations. 1. Provisions held unconstitutional or invalid are completely severable, and the remaining provisions of these Zoning Regulations remain in full force and effect. 103 Effective Date A. These Zoning Regulations take full force and effect on the date their adopting ordinance is published in the official city newspaper. 1. These Zoning Regulations must be adopted by the Planning Commission, and approved by the Governing Body. 2. The adopting ordinance must incorporate these Zoning Regulations by reference.
