103 Applicability A. Applicability. These Subdivision Regulations apply to any property owner within their jurisdiction who wishes to: 1. Vacate a right-of-way, easement, public reserve, or recorded plat. 2. Divide or subdivide land into two or more lots or parcels, or alter the boundaries of existing lots or parcels of land. 3. Develop a plat which specifies lots or parcels, and establishes land to be used for streets, alleys, utilities or other public uses, unless exempted under the following Section 1-103B. B. Exemptions to Applicability. Despite the jurisdiction and applicability requirements noted in the previous Sections 1-102 and 1-103A, these Subdivision Regulations do not apply under the following circumstances: 1. When any lot, parcel or tract of land located within their jurisdiction has been legally subdivided, resubdivided or replatted, and recorded prior to the effective date of these Subdivision Regulations . 2. When land in the unincorporated area is divided to create a single additional lot or tract , and meets the following conditions: a. Will be used only for agricultural or single-family residential purposes. b. Does not require any new streets or access easements. c. Includes enough land which is not subject to flooding to support a dwelling. (See definition of FLOODPLAIN.) d. Meets standards for water supply and sewage disposal, including lot size, as set by these Subdivision Regulations.
