D. If the Planning Commission determines that the preliminary plat does not satisfy requirements, and that modifications would be too extensive or impractical, it must disapprove the preliminary plat . 1. As soon as possible, the Subdivision Administrator must notify the Subdivider in writing of the Commission's disapproval of a preliminary plat. a. Notification of disapproval must be provided to the Subdivider within 60 days after the preliminary plat was filed. 104 Planning Commission Failure to Act on Preliminary Plat A. The Planning Commission must approve or disapprove a preliminary plat within 60 days after the date it is filed with the Subdivision Administrator, or from the date the Subdivider files the last item of required data, whichever date is later. 1. The Subdivider may consent in writing to extend or waive the 60-day time limit . 2. If the Subdivider does not extend or waive the time limit, and the Planning Commission fails to act within the 60-day time limit, then the preliminary plat must be considered approved.
103 Planning Commission Action on Preliminary Plat A. The Planning Commission must review the preliminary plat, and determine whether it generally meets the design standards and requirements of these Subdivision Regulations, the Comprehensive Plan, applicable zoning regulations, the County sanitary code, and other applicable provisions of Andover City ordinances. 1. The Planning Commission must consider the comments and recommendations of the organizations to which the preliminary plat was submitted for review. 2. The Planning Commission may conduct a public discussion at its meeting to receive information supporting or opposing the preliminary plat. a. The Planning Commission may provide notice of its meeting and an agenda to interested parties. B. If the Planning Commission determines that the preliminary plat satisfies requirements , it must approve the preliminary plat, and notify the Subdivider in writing of its approval. C. If the Planning Commission determines that the preliminary plat does not satisfy requirements , it may suggest modifications . 1. The Subdivider may amend the preliminary plat to incorporate the Commission's suggested modifications, and resubmit the plat to the Commission. If the modifications are satisfactorily incorporated, the resubmitted preliminary plat will be approved by the Commission. 2. If the Subdivider rejects the suggested modifications or takes no action within the time allowed for Commission action, the Commission will disapprove the preliminary plat, and notify the Subdivider in writing of the reasons for its disapproval.
