102 Planning Commission Failure to Act on Final Plat A. The Planning Commission must approve or disapprove the final plat within the 60 days designated by state law for its consideration. (See K.S.A. 12-752[b].) 1. The Subdivider may consent in writing to extend or waive the 60-day time limit. 2. If the Subdivider does not extend or waive the time limit, and the Planning Commission fails to act within the 60-day time limit, then the final plat must be considered approved, and a certificate of approval must be issued by the Secretary of the Planning Commission. 103 Submitting Final Plat to Governing Body A. Before a final plat is recorded, it must be submitted to the Governing Body, which will consider acceptance of land dedications with guarantees for installation of required improvements. (See Subdivision Regulations, Section 7-108D.)

104 Governing Body Action on Final Plat A. Within 30 days after the first meeting of the Governing Body following the date the final plat is submitted to the City Clerk, the Governing Body must either accept or not accept the dedication of any land for public purposes. (See K.S.A. 12-752[c].) 1. The Governing Body may defer actions for an additional 30 days , to allow modifications to comply with Governing Body requirements. (See K.S.A. 12-752[c].) 2. If the Governing Body defers action on the plat, or declines to accept the land dedications, the Governing Body must advise the Planning Commission and the Subdivider in writing of the reasons. 3. If the Governing Body accepts the dedications , a statement of their acceptance must be shown on the final plat, signed by the Mayor and attested to by the City Clerk. 105 Acceptance of Dedications by County A. All final plats outside the City must also be submitted by the Subdivider to the Board of County Commissioners, which will consider acceptance of land dedications with guarantees for installation of required improvements. (See Subdivision Regulations, Section 7-108D.)
