B. Appeals. Direct any appeal regarding standards, plans, or engineering drawings of required improvements to the applicable Governing Body . 1. The Governing Body's decision on such an appeal is final . 102 Exceptions for Existing Improvements A. The Subdivider is not required to duplicate existing improvements, which are determined by the applicable Governing Body to be in good condition. 1. The Subdivider must repair or replace any existing improvements as necessary, so they comply with all Subdivision Regulation requirements. B. A land dedication sufficient to meet street standards is required where a proposed subdivision abuts or contains an existing public street with less than the minimum required right-of-way width or roadway width. 1. For street design standards, see Subdivision Regulations, Sections 8-107 and 8-108 . 2. At the boundary of a proposed subdivision, the applicable Governing Body determines what adjustments are required to merge the Subdivision's widened streets with existing smaller streets. C. if an existing roadway is already improved at both ends of a proposed subdivision extension, minimum right-of-way and roadway width requirements may be reduced to match the existing roadway.

ARTICLE 7. REQUIRED IMPROVEMENTS 100 Improvements Required for Plat Approval A. As a condition for final plat approval, the Subdivider must either install necessary facilities and improvements, or arrange for their installation in cooperation with governments and utility companies. (See K.S.A. 12-6(a)01.) 1. The Subdivider must provide improvements necessary to facilitate development of adjacent land, including extending street sand sizing pipes to support future loads. 2. All requirements for improvements apply to both urban- and rural-type subdivisions as defined in these Subdivision Regulations, Section 8-100B. 3. When existing utilities or improvements must be relocated due to the construction of a subdivision or its required improvements, the Subdivider is solely responsible for the cost of relocation. a. Existing utilities or improvements may include sanitary or stormwater sewers, water lines, drainage channels,

culverts, underground or overhead electric and communication lines, gas lines, pipe lines, or transmission lines.

101 Waivers and Appeals. A. Waivers. Only the applicable Governing Body may waive required improvements or guarantees for their installation. 1. Required improvements or guarantees for their installation may be waived only on a showing that the improvements are not necessary or not technically feasible.
