C. Under the advanced construction procedures of Subdivision Regulations, Section 7-105E , a plat becomes null and void if the final plat has not been recorded with the County Register of Deeds within 60 days after its final acceptance by the City Governing Body, or within 15 days after final acceptance by the County Governing Body. 1. When a plat becomes null and void, the Subdivision Administrator must notify the Subdivider. 2. Unless a reapplication for platting is received within 30 days after a plat becomes null and void, the case file will be removed from City records. (See Subdivision Regulations, Section 6-106 for Recording of Final Plat.) 101 Vacation of Recorded Plat by Replatting A. When a PLAT or REPLAT covers the same land as that within an earlier plat or part of a plat, and is duly executed in accordance with these Subdivision Regulations and recorded with the County Register of Deeds (see K.S.A. 12-403) , then the earlier plat or replat must be vacated both as to use and as to title without any further proceedings. (See K.S.A. 12-512b.) 1. This procedure applies both inside the City and in the extraterritorial subdivision jurisdiction area. 2. This procedure applies to any recorded plat or part of a plat, street, alley or other public reserve, including easements, dedicated building setback lines, and access control, whether established by instrument, condemnation or earlier plats.
ARTICLE 11. VACATIONS & CORRECTIONS 100 Vacation of Unrecorded Plat
A. A preliminary or final plat may be withdrawn from the Planning Commission's consideration on request, either before or after approval. 1. A request to withdraw a plat must be submitted by the Subdivider in writing to the Planning Commission. 2. When a motion for a withdrawal request is approved, the Subdivision Administrator will remove the case file from City records. B. A final plat, including plats for which dedications have been accepted, may be vacated by a motion of the applicable Governing Body. 1. A request to vacate a plat must be submitted by the Subdivider in writing to the City Clerk. 2. A plat may be vacated only if all of the following conditions are met: a. The plat has not been recorded. b. No zoning lots have been sold or transferred. c. No improvements have been installed. 3. After the plat is vacated, the Subdivision Administrator must see that all fiscal sureties are returned to the Subdivider, except for expenditures incurred by the City or County in administrative, legal or engineering costs prior to the date of the vacation request. a. When sureties are returned, the Subdivision Administrator must remove the case file and any associated petitions from City records.
